From: roc@xpresso.seaslug.org (Bill Vance) Subject: FCC Public File Auto-FAQ Date: 01 Mar 2001 00:59:51 PST This "FAQ" is auto-posted once a month via cron triggered script, and may be triggered off by hand from time to time in between if the info is requested by someone, such as when the House recently voted down the AW Ban and the Media threw a hissy fit. The purpose of this FAQ is to inform people what they can do about Media generated lies and misinformation. While the FCC only handles Broadcast Media, (TV and Radio), some of these techniques will work for magazines and newspapers too. If I've missed something, or you find errors, let me know and I'll add/fix it. 1.a. Send letters of complaint to the Station Manager every time it happens with all the time, details, other info, and your complaint(s). 1.b. Send an additional copy for their FCC (Federal Communications Commission) Public file. 1.c. Send an additional copy to the FCC itself, in case they don't put it in their Public file. 2.a. Send a letter of complaint to their Station Owner as per above, with copies as per above (1.b and 1.c). 3. Send copies of their replies to you along with yours to them to their FCC Public file, so that it gets nice and fat, again, with copies to the FCC itself. 4. If you can afford it, send all corespondence by Certified Mail with Return Receipt Requested. Send a copy of the Return Receipt with everything that goes to the FCC itself, so that they will have additional evidence if the Station is cheating on their Public File. 5.a. Go to the Public Library and look up "Standard Rate and Data Services" (SRDS) "Directory of National Advertisers." It is found in many major Libraries (in the business/reference stacks), and lists EVERY current advertiser, who the players are at both the company and advertising agency(s), and the appropriate telephone and fax (and probably E-Mail by now) addresses. If your Library doesn't have it, it can be requested. Otherwise you can watch their commercials for a few days to a week, listing all their advertisers. There are other references that have the addresses for the nation's business headquarters too. look them all up and pass the addresses and phone/FAX numbers etc., around so that everyone can bitch to the sponsors. IF enough people do that, it'll get back to the Station. Tell them if the Station continues their nastiness you'll _consider_ changing to brand(X), (otherwise they'll just write you off as a loss). 5.b. The above, (5.a.), can be a lot easier and less time consuming if you're dealing with a newspaper's or a magazine's ads, as they are right in front of you for the listing. 6. If they put on something good or even just more reasonable, call and compliment them on it, but do _not_ send any kudos to their FCC file, or write to them about it. That way they have to keep it up and hope, as there is nothing good in the file or in writing that they can show the FCC to justify their Station's License. 7. Heston didn't budge. Faced with impending doom, the Villanova dogmatics were desperate. Time to call the heavy artillery. The hotline rang to "The Center For Peace And Justice." CPJ is the campus political correctness police. Look up CPJ on the Villanova website, and you'll find Amnesty International, Bread For The World, Democratic Socialists of America, International Coalition Against Racism, Villanova Environmental Group, Villanova Feminist Coalition, a who's-who of Villanova liberalism. CPJ is not an ad-hoc student group. It's an accredited Arts and Sciences program. You can learn self-victimization, race-baiting, even protesting. As a major! CPJ not only supports campus liberals, they actively attack Villanova conservatives. And that's how the CPJ entered the fray. When everything else failed, CPJ organized, incited and sponsored protesters for Heston's event, and made sure Heston's people knew. Still, Heston didn't flinch. The only thing left was to bankrupt Lilik's event. Villanova claimed it now needed 21 security guards required to police the school-sponsored protesters, to the tune of $1,827.00. Even that extortion scheme didn't work. Heston was coming. Obviously miffed, Villanova needed another target. Earlier that week, Vasavi Reddy, Villanova's liberal darling and CPJ graduate accused Lilik of racism because the Villanova Times poor print quality inadvertently made black people appear like "black blobs" in his newspaper. Lilik was livid. He was showing campus diversity by including friends of color. That's racism? Not one administrator came to Lilik's defense. None. Enter Tom Adkins. I admit it. I am a political Don Quixote. I insist upon righting all wrongs. Shocked, I wrote a scathing letter attacking race-baiting Reddy and exposing the CPJ as a corrupt liberal enforcement agency. Lilik printed it. The university went nuts. They threatened to bar me from campus and demanded Lilik remove me from the event. Lilik wouldn't budge. Finally, Villanova approached Heston's security people, hysterically claiming I was a crazed racist and the entire campus was ready to storm the event if I spoke. Frightened, Heston's handlers threatened to withdraw if I spoke. Finally, to preserve the event, I withdrew. The Heston event went great. The protesters couldn't fill a school bus. But Villanova got their pound of flesh from Lilik, jacking up expenses so he lost money. And they silenced a conservative critic who busted their indoctrination program. But it cost them. The story made dozens of major newspapers, and Lilik told 5 million people on Fox News' The O'Reilly Factor. Now, the world knows Villanova is preaching hate in the name of caring, division in the name of unity, selectivity in the name of diversity, and censorship in the name of freedom. Last year, congressional leaders managed to head off such an effort and awarded members a 2.7 percent pay increase. Aides said Hastert and House Minority Leader Richard A. Gephardt (D-Mo.) oppose the idea as politically unpalatable, which means it is unlikely the lawmakers' demands will be met. At a time when companies are laying off workers and politicians are touting the need to restrain federal spending, they argued, House members would be hard-pressed to justify tens of thousands of dollars in additional compensation. One GOP leadership aide called it "a PR disaster." Fred Wertheimer, president of the public watchdog group Democracy 21, suggested that the idea would prompt a flood of protests from voters. "It seems like absolute madness. If House members want a $25,000 salary increase, then they ought to vote on it," Wertheimer said. "It's very important to talk about, because I don't think we need a society of multimillionaires in the House." The idea is particularly popular among lawmakers from California and New York, whose state legislators receive a generous per diem when they travel to the state capital. Many of these House members also come from relatively safe seats, making them less nervous about the prospect of angering voters. Past attempts to provide a daily allowance sparked controversy. In 1982, the House voted overwhelmingly to reverse a provision -- adopted a year earlier -- that gave lawmakers a $75-per-day audit-proof tax deduction. For the moment, neither party's leader appears eager to take up the crusade. Hastert spokesman John Feehery said on Thursday: "My understanding is that it's not going to happen." Most active dealers have had a telephone call from BATF's Tracing Center at some time or other inquiring about the disposition of a firearm whose serial number traces to the dealer. This is usually an inquiry concerning a third party and does not implicate the dealer. It should normally occur during your listed business hours, although emergency traces in high- profile matters could occur at any time of the day or night. These inquiries are authorized by law in official criminal investigations and as a licensee you have a statutory duty to cooperate by furnishing the requested information. Be aware, however, that the Tracing Center is a part of BATF's criminal enforcement apparatus whose function (and principal interest) is to put people (including firearms dealers) in jail. You should always obtain the full name and telephone number of the caller and note it in writing. An entry in your bound book alongside the entry for the firearm involved would not be inappropriate. If in doubt about the caller's identity, you should terminate the call and call back before giving any information. Coopeeration would include supplying copies of any related documents. Never surrender an original document or legally-possessed firearm (or other property for that matter) except in response to a summons, subpoena, or court order, and then only after obtaining legal advice. When faced with the prospect of providing information to the government, keep in mind that there are only two legal options: silence or complete truthfulness. Lying (even by partial truths or literal but misleading true answers) is never an option. A false statement to a federal officer in his official capacity is a felony akin to perjury, and usually much easier to prosecute and prove than the matter being investigated. If you cannot speak truthfully without incriminating yourself or injuring your legal interests, then remember RULE ONE. If the inquiry is about a Title II firearm, you should attempt to determine if the trace was initiated by local law enforcement. If it was, you should remind the caller that the information requested is privileged tax information and that it is a federal felony for BATF to disclose the information outside the agency. Your interest in this aspect is that you do not wish to aid and abet the commission of a felony -- even one committed by a federal official. Occasionally a tracing inquiry will be made in person by one or more special agents. They are, of course, purely criminal investigators whose only function (and interest) is to put people (including firearms dealers) in jail. Write down the names and badge numbers of all present. If anyone present is not a BATF special agent, inquire why that person is present (and later note the response in writing). If there is more than one agent, inquire why. If anyone refuses to display official identification direct them to immediately leave the premises. If they refuse, call the local sheriff or police and make a trespassing complaint. Do not allow anyone to search your records, premises or inventory for the information or items being sought. You or your employee do the searching, retrieving and copying. The same rules apply with respect to refusing to turn over original documents or items of personal property. If an agent should physically insist on taking custody of an original record or legally-possessed firearm or other item of property, resist verbally and vigorously, but not physically. Advise him calmly that your first call after he leaves will be to your lawyer and his first call will be to the Inspector General of the Treasury Department. Successive calls will then also be made to BATF's Office of Internal Affairs, the agent's SAC (Special Agent in Charge), the United States Attorney, the FBI and the sheriff -- the latter three to report the theft of your property by a federal agent. Then do it. In short, if an agent is stupid enough to violate your Fourth Amendment right to be secure in your papers and effects in front of God and everybody, then he needs to have his whole day ruined. A tracing inquiry is usually directed at a third party recipient of a firearm which has passed through your hands at some point and generally is not targeted at you. However, if you sense that the inquiry is, in fact, targeted at you, you should immediately terminate the inquiry, ask the agents to leave the premises (after which they are legally trespassers), request them to put their inquiry in writing, and seek legal counsel. Remember RULE ONE. Failure to cooperate in a tracing request can put your license at risk, but loss of a license (or the expense of defending it) compares very favorably with a prison sentence (or the cost of defending a criminal indictment). And your license is not realistically at risk if BATF is trying to further a criminal investigation of you through a pretext tracing inquiry. The majority of all inmates talk their way into prison; you have no legal obligation to help put yourself there. This type of confrontation is an IQ test. Don't flunk it; remember RULE ONE. Clients occasionally inquire about tape-recording their telephone or in-person conversations with BATF employees (and others). This is legal under federal law so long as one party to the conversation (you) knows of the interception. However, state laws vary on the issue and you should be certain that such consensual recording is legal under the law of the state where the recording is taking place. You should never record a conversation (telephone or otherwise) where no one present knows of the interception. This is a felony violation of the federal wiretapping statute, and you are creating the very evidence needed to prove it. You can, of course, legally tape-record any transaction in any jurisdiction when all parties are aware of the taping. Any such tape should itself reflect that all present are aware of the taping. You should never knowingly consent to your own interview or conversation being tape recorded without making a tape of your own. More important, the taping of your interview is a strong signal to invoke RULE ONE and immediately seek legal counsel. The Third-Party Inquiry. A third-party inquiry is broader than a simple tracing inquiry, but otherwise involves the same principles and recommended reactions. It could be a telephone call, but will ordinarily be a personal visit by one or more special agents who are after more detailed information than just the acquisition and disposition of one or more firearms which have passed into or through your inventory. All other factors remain the same and your responses should be the same as for the in-person tracing inquiry. Needless to say, if the inquiry is not about a third-party transaction but rather is directed solely at you, invoke RULE ONE and seek legal counsel immediately. Remember, refusing to talk to federal criminal investigators and seeking legal counsel are not admissions of guilt or signs of a guilty conscience. They are manifestations that you are an American citizen aware of your legal rights and an individual who will not be bullied, coerced or frightened into giving up those rights. The agents already believe you are guilty; their job is to prove it. Your job is to avoid helping them prove it. The Undercover Solicitation. This may be a contact by BATF which, if you are fortunate, you never learn was made. It is a sad fact that a high percentage of non-violent federal gun crimes committed in the United States (perhaps even a majority) are manufactured by BATF -- crimes that would never have occurred but for the fact of an offer from or solicitation by a BATF informant or undercover agent to an unwitting citizen. Technically, most of these BATF-sponsored offenses do not rise to legal entrapment. But they would never have happened if BATF had not planted the idea and created the opportunity. This is done for the simplest and ugliest of all bureaucratic reasons: agent and agency self-preservation and budget and case statistics. Sometimes you will know you are being shopped -- perhaps by recognizing the agent or perhaps by the sheer stupidity of the approach. You are probably also being recorded, possibly even videotaped. Your response should be precisely the same whether it ultimately turns out that you were speaking to a government microphone or to the village idiot. You should firmly, but not politely, advise the proponent that what he/she is proposing is illegal and that he/she is no longer welcome on your premises or at your table. Then remember RULE ONE. Do not engage in a discussion of the law or alternative solutions to the "customer's" proposal; terminate the conversation. Politeness is not called for when someone is either intentionally or ignorantly soliciting you to commit a federal felony. And your politeness on a federal tape recording in a subsequent criminal prosecution can often be construed as acquie escence in or lack of strong feeling about committing a crime. Some of my bolder clients, who are truly tired of being harassed this way, are fully prepared to make a citizen's arrest in such circumstances and then call the local sheriff to come collect the offender (attempts and solicitations to commit an offense are also crimes under federal and state law). If this appeals to you, make sure first that the law of your state permits a citizen's arrest. Know the amount of legal force you can use to effect such an arrest. Then cuff the son of a bitch and give him a taste of what he's probably trying to do to you. A criminal solicitation by someone you've known for years, and who you know cannot be an agent, is especially dangerous. It probably means that your acquaintance has gotten his own tail in a crack and is now making cases for BATF in an attempt to lighten his own load. Finally, bear in mind that an undercover approach may be made by a female agent or by a mixed couple. The Compliance Inspection. Compliance inspections are conducted by inspectors of the regulatory enforcement branch of BATF. These individuals have no criminal law enforcement authority -- or training (although they have recently been issued badges, perhaps in an effort to bolster morale or create an appearance of authority for low-paid personnel). Theoretically, inspectors are charged with the civil and regulatory aspects of firearms law. They do not have the power of arrest or the authority to serve subpoenas or warrants. Nor may they make seizures of any kind. I say "theoretically" because in some recent instances inspectors have been observed accompanying special agents on raids and even illegally carrying firearms. In short, there are some cop wannabes among the inspector force whose intrinsic suspicion of firearms dealers as criminals must be guarded against. The legally-authorized purpose of compliance inspections (and pre-licensing inspections) is to ensure that the firearms statutes are generally being complied with by the firearms industry. The true job of inspectors is to spot and correct discrepancies in compliance with federal firearms statutes, to establish the qualifications of license applicants, and to enforce and collect the excise tax on the manufacture and importation of firearms. If an inspector discovers evidence of a criminal violation he is supposed to make a referral to the criminal enforcement branch of BATF (the special agents). As a licensee you are required to display your license on your licensed premises, to maintain certain required books and records accurately, and to submit to a compliance inspection of your licensed premises, your inventory and your required records as often as once annually. The only firearms records which you are required by law to maintain, and to submit for inspection, are an acquisition and disposition book (your bound book), original BATF Forms 4473, Firearms Transaction Record for each firearm sold, original BATF Forms 5300.35 Statement of Intent to Obtain a Handgun(s) (the Brady Act form), and your retained copies (copy 4) of BATF Forms 3310.4, Report of Multiple Sale or Other Disposition of Pistols and Revolvers for each multiple sale of handguns. Special occupational taxpayers may also be required to produce their Forms 2, 3, 5, 6 and 10 for firearms on hand. There may be additional state law records required of a dealer, but BATF has no jurisdiction over these records and arguably no jurisdiction to inspect them. When a BATF inspector shows up for a compliance inspection, require credentials to be displayed by everyone present and note the full name of the inspector(s) in writing. Never permit a special agent or a state or local or non-BATF federal official to participate in a compliance inspection. These individuals have no authority under the inspection laws, and are there for some different (and more ominous) reason. A state official might have independent state-law authority to conduct aninspection or investtigation, but he has no right to do it in tandem with a BATF compliance inspection. You should require other inspectors or investigators to get in line so that you can deal with them at a separate time. If they refuse to leave, call the sheriff and swear out a trespassing complaint. You should never consent to more than one compliance inspection in any twelve-month period. Require BATF to obtain an inspection warrant and immediately seek legal counsel. Under general principles of law a compliance inspection must be "reasonable" in terms of time, duration, scope, number of inspectors, lack of disruption to your business, etc. If the inspector is reasonable and professional, you should be too. The process does not have to be adversarial or antagonistic. If the inspector is not reasonable or professional, keep in mind that your license does not require you to talk to him, or to provide him access to your copy machine, rest room, etc. If you are dealing with an idiot, remember RULE ONE -- and let him bring his own copy machine. Also remember that he has no right to use your electricity. The inspector is legally entitled to inspect all your required records, your business premises, and your firearms inventory. He is legally entitled to inspect nothing else. You should not permit inspection of non-required records unless there is a satisfactory explanation of why it is desired (such as inspecting a purchase or sale invoice for the correct serial number where the bound book and the Form 4473 show different serial numbers for the same firearm). You should not permit inspection of non-business portions of the premises when your home is the licensed premises. (When your business is conducted from your home, you should carefully delineate that portion dedicated to the firearms business and confine the business strictly to that portion of the premises.) You should accommodate the inspector by making copies of any records desired (within reason). Never permit original records (or firearms or other property) to be removed from the premises without a summons, subpoena or court order, and without seeking legal counsel. The inspector has no power of seizure and may attempt to bluff his way into removing original records or may try to obtain your consent. Do not be bluffed and do not consent. Inspections should be conducted on your premises. (If you store firearms off premises, the inspector is also entitled to inspect such storage facilities.) A compliance inspection of a special occupational taxpayer will begin with the inspector attempting to reconcile his NFA Branch printout of Title II firearms shown as registered to you in BATF's records with the actual Title II firearms in your possession. He will be unable to do so because of the abysmal state of the national registry. Have mercy on him and help BATF untangle its records. Try to refrain from thinking about whose records and recordkeeping should really be under audit here. The inspector will also likely need your technical expertise in identifying anything more esoteric than a rifle, pistol or shotgun. Try to conceal your contempt for a "federal firearms inspector" who probably doesn't know a wipe from a baffle, or a lightning link from a drop-in sear, and who may think a Mauser broomhandle is something used by a German hausfrau. If you are a firearms manufacturer or importer, an inspector may plan to conduct an excise tax audit at the same time as a compliance inspection. The authority for these two types of inspections/audits derive from entirely different legal authorities and they involve entirely separate legal considerations. You should insist that either the audit or the inspection be conducted first and separately. The reasons are expanded on under the Excise Tax Audit section, below. Curio and relic (collector) licensees have the legal option of bringing their records and firearms to the nearest designated BATF office for a compliance inspection. Although I am unaware of any compliance inspection of a collector, this is an option to be considered seriously. The simple truth is that you never want a BATF employee in your home if it can be avoided. In summary, the firearms regulatory process does not assume you are a criminal, but rather seeks to ensure that dealers generally are complying with the requirements of the law. If bona fide, the process does not require invocation of your various rights to notice, counsel, warning, non-self-incrimination, etc., which all come into play when you are the target of a criminal investigation. Unfortunately, BATF sometimes attempts to avoid these constitutional "inconveniences" by illegally using the access of civil inspectors to further a criminal investigation without alerting the targeted dealer. You should never cooperate in such a subterfuge. The Excise Tax Audit. If you are simply a dealer in firearms or ammunition, you will have no occasion to undergo an excise tax audit. However, if you manufacture or import firearms or ammunition you are subject to audit by the regulatory enforcement branch of BATF. The manufacturers excise tax on firearms and ammunition is one of the most complex and least understood federal tax statutes. It is said that only three people in the world completely understand it. One is dead, one went mad trying to explain it, and modesty prevents me from naming the third. Suffice to say, however, that BATF, which acquired jurisdiction over the tax from IRS in 1991, is hopelessly inept in administering it. An excise tax audit is governed by the general principles of the Internal Revenue Code of 1986 and not the National Firearms Act of 1934 or the Gun Control Act of 1968. You are required to maintain the same records any other taxpayer/return filer is required to maintain: whatever records are necessary to support the figures on your return. There are no records specifically required by law to be maintained such as those required of dealers by the Gun Control Act. And, absent tax fraud or evasion, there are no criminal penalties for failing to maintain such records. Therefore, the only penalty for failing to keep excise tax records, or to produce them, is that BATF could choose to treat all your sales as taxable events. As a practical matter a logbook of operable Title I firearms manufactured by you plus any BATF Forms 2 (Title II firearms manufactured by you), and a file of BATF Forms 6A, operable firearms imported by you, accompanied by your bound book showing the same firearms sold by you and sales invoices showing the sale price, would be all the records required for a proper excise tax audit (in addition, perhaps to your retained copies of excise tax returns filed). You should decline to produce any other records for an excise tax audit unless you have an alternative pricing issue under the excise tax regulations or tax-exempt sales (to a government entity, the military, or for export). You should also be aware that the definition of firearm under the excise tax statute is different from other statutory definitions of "firearm." Excise taxable firearms are only those complete portable firearms which go bang. The tax does not apply to crew-served weapons, silencers, frames or receivers, conversion kits, parts, most destructive devices, etc., etc. The tax only becomes due on a sale or its commercial equivalent. A transfer of a complete Title II firearm which goes bang is not always a sale and does not always trigger the excise tax. Even when it is a sale, it is not taxable if the Title II transfer tax is being paid (a Form 4 transfer). There is also no excise tax due on the manufacture or importation and sale of blank ammunition. I cover these points because BATF inspectors are generally excise-tax illiterate and much excise tax is asserted and collected which is not legally due and owing. If you are a firearms manufacturer or exporter, you should have competent tax counsel. The Raid. This is an event which means you are in deep, serious. It is the execution of a judicially-issued search and seizure warrant (and occasionally also an arrest warrant) by BATF special agents, frequently accompanied by agents of other federal or local agencies, on premises owned, occupied or inhabited by you. When a raid team shows up at your premises and announces (usually by breaking down your door, sometimes by killing your dogs and throwing flash bang grenades at your women and children) that they have a federal search warrant, you must instantly do several things. You must first of all mentally assimilate the fact that they are law officers rather than a rampaging motorcycle gang (which they often resemble in both appearance and behavior). Having identified them as law rather than outlaw, you must freeze in place in a non-threatening posture and attempt to stabilize the situation until some of their law-enforcement adrenalin (the most dangerous drug on the street) has bled off. If only a search warrant is involved, you must then recover your wits sufficiently to do the following: (A) Try to note and record the identities of as many participants as possible, by name, agency, badge number, and physical description. (B) Ask for a copy of the warrant. (C) Disable -- not unplug, disable -- your telephones and fax machines. (D) Gather your family, children and pets and leave the premises. (E) Call your lawyer. You may be prevented from doing some or all of the above things by legally illiterate agents, but that will simply lay the foundation for your own day in court. A federal search warrant authorizes only the search of a specified premises and only the seizure of specifically described items. Corollary to the execution of a warrant, the law permits the agents to make a forcible entry if that becomes necessary after knocking and announcing their identity and purpose, to control the premises, and to take reasonable precautions for their own safety -- such as a pat down for weapons of those persons present and assigning an agent to watch over and accompany anyone moving about on the premises. The law authorizes the agents to prevent the destruction of evidence or contraband and it protects them against being assaulted or interfered with. It is a serious federal crime to assault a federal officer or to obstruct execution of the warrant. Don't turn a possible later indictment into a sure one. Never assist the raiding party in locating the items described in the warrant. They have the right to search, but not the right to find. Do not open locked compartments, safes or rooms for them or provide them with keys or combinations. Do not talk to the raiding officers other than to request identification and a copy of the warrant. Resist the compulsion to show what a good guy you are; these are not your friends and they are not there to help you. A search warrant does not authorize agents to arrest you or anyone else on the premises (although assaulting the agents or forcibly interfering with the execution of the warrant will justify a warrantless arrest) and it does not authorize them to handcuff you, restrict you to a particular place or prevent you from leaving. You have a perfect right to leave the premises and should do so immediately. If you are physically prevented from leaving, you have just been falsely arrested in violation of the Fourth Amendment and will have your recovery later in court as well as taking some of the other retaliatory measures promised above. You must get yourself and your family out of the house for several reasons: (A) to avoid the personal insult, humiliation, provocation and indignities which many agents seem to enjoy; (B) to avoid a potential life-threatening situation; and (C) to avoid creating evidence against yourself (RULE ONE). There is no useful purpose your remaining on the premises can serve; if the agents are going to plant evidence or destroy property, they will do it whether or not you are present. You will need as much information about identities, badge numbers and descriptions as you can manage in the minutes before you leave. These will be useful later when you assert or defend your rights. But they are not a reason to delay leaving the premises promptly. You are legally entitled to a copy of the warrant, but do not remain on the premises if you are refused. You should disable your telephones and fax machines before leaving in order to prevent the agents from illegally seizing evidence (calls and faxes) which might come in while they are on the premises. Such items did not exist when the warrant was signed and cannot possibly be covered by the warrant. Their seizure will probably therefore be illegal; but it is better to prevent such seizures from even happening. If you are physically prevented from disabling your own property, go somewhere else and place in ncoming calls to all your lines and keep the circuits open. Now, call your lawyer. In the U.S., the rate was 2.6 percent, according to 1995 figures; "After Australia and England and Wales, the highest prevalence of crime was in Holland (25 percent), Sweden (25 percent) and Canada (24 percent). The United States, despite its high murder rate, was among the middle ranking countries with a 21 percent victimization rate," the London Telegraph said. England and Wales also led in automobile thefts. More than 2.5 percent of the population had been victimized by car theft, followed by 2.1 percent in Australia and 1.9 percent in France. Again, the U.S. was not listed among the "top 10" nations. The study found that Australia led in burglary rates, with nearly 4 percent of the population having been victimized by a burglary. Denmark was second with 3.1 percent; the U.S. was listed eighth at about 1.8 percent. Interestingly, the study found that one of the lowest victimization rates - just 15 percent overall -- occurred in Northern Ireland, home of the Irish Republican Army and scene of years of terrorist violence. Analysts in the U.S. were quick to point out that all of the other industrialized nations included in the survey had stringent gun-control laws, but were overall much more violent than the U.S. Indeed, information on Handgun Control's Center to Prevent Handgun Violence website actually praises Australia and attempts to portray Australia as a much safer country following strict gun-control measures passed by lawmakers in 1996. "The next time a credulous friend or acquaintance tells you that Australia actually suffered more crime when they got tougher on guns ... offer him a Foster's, and tell him the facts," the CPHV site says. "In 1998, the rate at which firearms were used in murder, attempted murder, assault, sexual assault and armed robbery went down. In that year, the last for which statistics are available, the number of murders involving a firearm declined to its lowest point in four years," says CPHV. However, the International Crime Victims Survey notes that overall crime victimization Down Under rose from 27.8 percent of the population in 1988, to 28.6 percent in 1991 to over 30 percent in 1999. Advocates of less gun control in the U.S. say the drop in gun murder rates was more than offset by the overall victimization increase. Also, they note that Australia leads the ICVS report in three of four categories -- burglary (3.9 percent of the population), violent crime (4.1 percent) and overall victimization (about 31 percent). Australia is second to England in auto theft (2.1 percent). In March 2000, WorldNetDaily reported that since Australia's widespread gun ban, violent crime had increased in the country. WND reported that, although lawmakers responsible for passing the ban promised a safer country, the nation's crime statistics tell a different story: Countrywide, homicides are up 3.2 percent. Assaults are up 8.6 percent. Amazingly, armed robberies have climbed nearly 45 percent. In the Australian state of Victoria, gun homicides have climbed 300 percent. In the 25 years before the gun bans, crime in Australia had been dropping steadily. That incident prompted some metro wag to say, "Zero tolerance equals zero intelligence." Many kids -- and unfortunately many adults -- say things they don't mean. Talking trash is probably the most nearly universal pasttime in America today, short of breathing. Maybe one person in a million actually tries to carry out such talk. So are we supposed to drag a million trash-talking kids into counseling to catch one kid who might mean it? On the one hand, it would (one hopes) ensure the safety of other kids. On the other, it would cause our kids to be brought up in a police state. At least it would provide more salient preparation for college than most anything else they get in high school these days... It's hard to tell people whose children have been subjected firsthand to horrors like Columbine and Santee that their desire to ensure their children's future safety may be out of proportion to the risk. Such parents are uninterested in statistics that demonstrate that, modern instantaneous news coverage to the contrary notwithstanding, school violence is far less common than when they were in school. Sensitivity toward those families is one thing, but misportraying reality to the general public is something else entirely. We know that certain politicians will callously exploit every tragedy to advance their agenda at the expense of the fundamental liberties of people who have never done anything wrong and never will. We also know that certain news outlets -- national news networks and major metropolitan newspapers, for example -- will cheerfully play along with those politicians. Excessive action, whether in legislation or by administrative fiat, will never prevent the criminally reckless from wreaking havoc. The criminally inclined will tend to find a way, and as for the stupid, there's an old saying: "There's no such thing as a foolproof plan, because fools are so ingenious." Once we've all become permanent suspects for crimes we'll never commit, and it becomes apparent that violent acts are still happening, what will be next? There is an example of wisdom imparted by an 18YO High School Senior which I have never heard publicized anywhere, in any form, other than the actual live broadcast I heard it on the day after the Columbine shootings. A PBS "roving reporter" was going around sticking a mike in kids' faces asking the kids, "What lesson can we learn from Columbine?" Anybody that parrotted the PC line, "We need more gun control!" got at least a minute or two to expound on their opinion. PBS stuck the mike on front of this 18YO, and he answered, "That's easy. Don't treat people like shit and they won't want to kill you." The mike was yanked off the kid, and he never got to say anything else on the air. This was a profound piece of wisdom and advice that PBS obviously didn't want broadcast any further. And the print Media, of course, has never breathed a word about such a lesson. It was about a small town where all the men, through some sort of clandestine medical procedure, turn their wives into robotic, zombie housewives. These creatures' primary goals in life were how clean they could get their floors, and how nauseatingly subservient they were to their husbands -- no matter how inept and ridiculous they were. Ross knew there was something really wrong when her normally outspoken, feminist best friend turned into one of these Betty Crocker androids. Ross was the only one who knew the women were behaving strangely and that something was frighteningly off kilter. Her desperate attempts at trying to alert her friends to this bizarre situation fall on deaf ears. Like Ross's character, I have experienced this Stepford Syndrome, although in a different context: As a teacher in the public school system. Let me explain. Being a libertarian for 20 years, particularly a libertarian woman, I've often felt somewhat apart from the crowd; certainly a contrarian in many ways. Couldn't imagine being otherwise. Although it frustrates and saddens me, I'm accustomed to most people shutting down, resisting, or getting angry at the profound and crucial message of freedom that libertarians like myself speak of. For a variety of reasons -- lack of knowledge, emotionalism, laziness, or fear -- people shut their eyes, ears, and hearts to the insane butchery of individual rights that is taking place all around them. Yet, I've known this for a long time; it certainly isn't anything new. But no matter what I've come up against as a libertarian, nothing (other than my own public education and my beliefs on how kids learn best) prepared me for the harsh reality of what I witnessed being done to kids in the public schools. And like Ross's character, I was stunned that nobody -- teachers, parents, and administrators -- thought anything was wrong. These were seemingly nice people, which made it much harder to understand why they didn't see the enormous amount of harm they were causing. Everywhere I turned, kids were subjected to some sort of emotional, physical, intellectual, or spiritual carnage. The cruelty and madness of the system demanded that I treat the children as they did. Fortunately, I failed: I lasted six months. I taught special education to 10 "intellectually disabled" (labeled "ID") kindergarten, first-, and-third graders. A few of them had legitimate, physiological problems, such as speech disorders, but the rest of them -- God forbid, individuals that they were -- simply did not fit into a system that was incapable of recognizing and nurturing the talents they already possessed or were developing. In fact, the system was bent on destroying any uniqueness, intellectual curiosity, or self-discovery that these kids brought with them into the school. This wasn't just true for the special education kids. It is required that all children who enter the doors of public schools leave any semblance of themselves outside. The intention of government schooling is not to encourage kids' natural love and passion for learning, and it's definitely not in the agenda to foster independence. The system is specifically designed to chip away, piece by piece, a child's inherent right to develop into an independent-minded, psychologically aware, autonomous human being. This is not an exaggeration. Because I saw what was happening and was not able to stop it, it felt like I was in prison. By the way, ever notice how schools look like prisons? This is no accident. A friend of mine calls the architectural style of some of the older schools "Gothic Penitentiary." The school I taught in had ugly yellow institutional tiling lining the hallway walls that reached above the childrens' heads. I imagined the kids must have wondered if they were in one giant bathroom. The environment was so madly chaotic that it was virtually impossible to learn anything, let alone finish a conversation. Many times I'd be in the middle of a discussion or project with a child and a bell would blast so loud, I'd have to cover my ears. Everyone else would be oblivious to the intrusion and move to another place -- like rats in a cage. Everybody rushed around as if something important was going on. If a child was in the middle of doing something, he'd better HURRY UP and finish so he could move on to the next meaningless task. In his book The Underground History of American Education, former New York State Teacher of the Year, John Gatto writes, "By bells and other concentration-destroying technology, schools teach that nothing is worth finishing because some arbitrary power intervenes both periodically and aperiodically. If nothing is worth finishing, nothing is worth starting. Love of learning can't survive this steady drill." How do public schools curtail, control, or trample a child's growing sense of self? And what are the real lessons learned by the child lurking behind the lessons being taught? Here are some examples I've seen in the short time that I was teaching. There are many more. * A 7-year-old boy walks into the class and finds his desk upside down and the contents dumped all over the floor. All the kids listen while the teacher admonishes this child for having a messy desk. The child remains standing, immobilized and embarrassed, looking at the floor. He learns it is okay to humiliate someone in front of others and that his property can be gone through without his permission. He learns disrespect for the property of others. * Children being forced to waste an inordinate amount of time waiting. They wait for other kids to finish their work; for recess; to go in after recess; for lunch; to go in after lunch; to answer a question; to ask a question; to go to the bathroom; to get on the bus; to take roll. They learn that wasting precious time is normal. They do not learn how to manage time for themselves. * One teacher refused to open the windows or shades and kept the class in a continuous semi-darkness. The psychological impact of sitting in a dark room every day is devastating. It causes depression -- not to mention eye-strain. To not be able to look out a window can certainly be likened to a prison sentence. * Bribery in the form of food, stars, prizes, "free time," alone time, grades, or other means of manipulation in order to get kids to learn material they found useless and boring; to get them to stop moving, talking, or anything else the teacher thought was disruptive to "the learning process." They learn to shut down their own natural joy of learning for its intrinsic rewards; and instead, perform like circus animals in order to get rewards. * Legally drugging kids with amphetamines or other psychotropic medications in order to control behavior. This is medicalizing and drugging normal childhood behaviors to control kids; which in turn, causes dangerous side effects and even death. Kids learn that they have no rights with respect to their physical and intellectual well-being. * Punishment in the form of humiliation and physical pain (corporal punishment), failing grades, isolation, prohibiting physical movement (taking away recess and making them sit in desks for hours on end), or verbal insults.I would cringe every time a particular teacher walked down the hall with her class. She always had something mean and nasty to say to some poor child. Kids learn that disrespect, cruelty, and physical force are the means used to getting what they want. They learn to treat themselves in the same fashion and they equate learning with drudgery, confinement, and pain. * Preventing healthy, meaningful relationships by artificially fragmenting time, separating younger kids from the older; "slower" from the "quicker"; popular from unpopular; competing with other students for teachers' attention; or teachers and administrators functioning as guards instead of caring mentors. Kids are conditioned to have a short attention span. They do not learn to effectively socialize with varying age groups or intellectual abilities. They learn contempt for "weaker" students and fear toward those who appear "stronger." * Making ridiculous rules and regulations that children inevitably break; such as not allowing toy guns, baseball bats and balls, and countless other fun toys and games that kids throughout all of human existence, in some form or another, have used for play. Along with all of the above, my school wouldn't let the younger kids climb too high on the playground equipment. It was on the playground, but they couldn't use it! The learning experiences of play are severely curtailed. Instead of the exhilaration and pride felt upon mastering developmental skills, kids learn hesitancy and fearfulness. * I was having a mundane conversation with a teacher. A child was sitting close by, timidly watching us. In a spiteful tone of voice this teacher says to him, "We're not talking to you; mind your own business." The child immediately looks down and tries to be invisible. The child learns not to be curious about what adults are saying and doing -- which is natural for children. He learns it is fine to speak to someone with harshness and contempt. * Kids have no privacy. There is nowhere to go to be alone -- even the private act of going to the bathroom requires permission and often surveillance, and the child had better HURRY UP and finish and get back to class! Children learn to be uncomfortable with being alone. They have problems taking initiative without asking an authority figure what to do. * There is no time for the child to discover what he or she loves. All time is taken up by what others deem to be useful or appropriate. One child I know of always had a messy desk and had trouble writing neatly. The teachers were always reprimanding him for this. One day he asked me if he could read a book to me. We sat in the corner while he read perfectly from The Lord of the Rings. He was 9 years old. The child learns that what he loves is unimportant and secondary to what others think is significant. After a while, what he loves is so buried, it is barely -- if at all -- accessible, especially to himself. * Kids being constantly told: "You need to learn this because you may use it when you're an adult." Or: "Follow directions without questioning because when you have a job, your boss is going to expect you to do as you are told." The student learns that for the rest of her life, she'll be a subordinant -- always being told what to do -- never being the boss herself. She learns that the present moment means nothing other than to provide for some obscure time or reason in the future. * Creativity, self-initiative, and originality are stamped out. All art classes (or other extracurricular classes) require kids to construct replicas of what the teacher makes. Successful artists, poets, and writers are not created within the public schools -- they survive and prosper in spite of their schooling. Again, a child learns that ingenuity is not something to be valued. Why is it that very few people are aware of what's happening to kids in the government schools? One reason is that most of us went to public schools so we don't even notice the huge detrimental impact they have on kids, families, and society. I think kids are retaliating with a deadly violence (Columbine, for example) to a system that mercilessly crushes them. Another reason, of course, is that the government should never have gotten involved in the business of education in the first place. The vast bureaucratic system of government schooling, like any dictatorial establishment, must fail. Let's hope so -- for the kids' sake. * References: Gatto, J. (2000). Laws against concealed carry of knives as well as guns, upheld in Tenn. but struck down in Kentucky. Differances in state constitutional provisions explain some of that. Georgia Supreme Court in Nunn verses State, struck down an 1837 law regulating both open and concealed carry and in so doing established that the 2nd amendment, as well as comparable provision in the state constitution protected a right of all citizens, and not just militia only. They did rule that the legislature could regulate concealed or secret carry, but not carry in general. You'll love the quote from this decision "Nor is the right involved in this discussion less comprehensive or valuable: "The right of the people to bear arms shall not be infringed." The court called the Connolly book "aggressive, derogatory and insulting", taking particular umbrage at the author's suggestion that Economic and Monetary Union was a threat to democracy, freedom and "ultimately peace". However, it dropped an argument put forward three months ago by the advocate-general, Damaso Ruiz-Jarabo Colomer, which implied that Mr Connolly's criticism of the EU was akin to extreme blasphemy, and therefore not protected speech. Mr Connolly, who has been told to pay the European Commission's legal costs, said the proceedings did not amount to a fair hearing. He said: "We're back to the Star Chamber and Acts of Attainder: the rights of defendants are not respected or guaranteed in any way; the offence of seditious libel has been resurrected." Mr Colomer wrote in his opinion last November that a landmark British case on free speech had "no foundation or relevance" in European law, suggesting that the European Court was unwilling to give much consideration to British legal tradition. Mr Connolly now intends to take his case to Europe's other court, the non-EU European Court of Human Rights in Strasbourg. That must have given them quite a boost to see someone from home. I wish you could see Vietnam now. My wife and I took our daughter there recently, and it is truly a garden spot. I served in the U.S. Navy for 27 years and worked in Vietnam as a military aircraft mechanic. I left the country in 1975. I have a column you wrote several years back, deploring the 30,000 deaths by guns in the United States every year. In Vietnam, civilians are not permitted to have firearms. Anyone who breaks this law gets three years in jail - which means one bowl of rice a day. Period. I admit it's strict, but it certainly is effective. The police in Vietnam have a baton and a whistle. There is no litter anywhere, and I mean NONE. These people are incredibly gentle and have the highest moral standards. There is enormous family pride. On March 8, 2001, U.S. District Court Judge George Lindberg ordered the Bureau of Alcohol Tobacco and Firearms (BATF) to release federal gun purchase records to lawyers for the city of City of Chicago. The records in question consist of "multiple purchase" forms filled out when one person legally purchases more than one handgun during a 5-day period from a single federally licensed dealer. Lawyers for the City of Chicago demanded the release of the records to support a lawsuit against gun manufacturers. In that lawsuit, Chicago contends that firearm manufacturers encourage Chicago residents to commit crime by "flooding" the city with handguns. The BATF opposed release of the information out of privacy concerns. The ISRA considers the records release an invasion of the privacy of persons who lawfully acquired handguns that were subject to the multiple purchase reporting requirements. Making the judge's decision even more troubling is the fact that gun purchase records from all 50 states will now be handed over to Chicago's attorneys. Given Mayor Daley's attitude about gun owners, there is no guarantee that the records will remain confidential and certainly no guarantee that Daley will not commence a campaign of harassment against persons whose names appear on the released records. "We're not talking about criminals buying guns here," commented ISRA president Richard Pearson. "We're talking about people who passed background checks and adhered to all federal and local laws. Another week of activity at the capitol as both sides started to line up their agenda. The week started off with the Senate Judiciary sub-committee on crime meeting and discussing a couple of gun bills. SB-256 which would define any gun show as if it were 2 or more people gathered to sell guns, and require all gun shows to conduct background checks on all firearms transfers was defeated. Shortly there after, SB-139, one handgun per month was brought up. Senator Cullerton opened with a short statement and the Chairman then allowed us to present our comments, asking us to keep it brief, as it was almost 6:00PM. Feeling a little under the weather, and having sat through almost 4 hours of law debates so far, we explained that it somehow seemed un-American that the government takes 30% of our income as it stands right now, and now Senator Cullerton seemed to want to dictate to us how we would spend the rest of the 70% of our income the government so graciously allows us to keep. The bill was defeated. The Senate is off next week and will return the week of the 20th. It appears that there will be a move to try and run the Senate version of the Daley package that week in committee. Having started off on a good note, Wednesday had us before the House Judiciary Civil Law Committee. The first bill was HB-906. This bill would require the notification the state police and local law enforce- ment of all persons who attempt to purchase a firearm without a FOID card. The bill came out of committee with an agreement for the sponsor to hold the bill until we can re-write the bill and address our concerns. The next bill up was HB-1789. This bill would allow for criminal charges against the person who sells a gun if the gun is used in a crime within one year. The term is "vicarious liability". Most law school students spend weeks debating the subject. It usually deals with the fact of should the get-a-way car driver be charged with murder, if the bank robbers kills someone during the hold up? In this instance, if you fail to withhold the delivery of a firearm by one hour, 23 instead of 24 hours for a rifle or shotgun, and then the person goes out 350 days later and kills someone with the gun you sold them, you can be charged with murder and face life in jail. If you fail to keep a written record as required under the FOID card act, a class A misdemeanor, you could then be facing a class x felony and 25 years at Stateville. The bill passed out of Committee by one vote when Rep. Jay Hoffman voted with the anti-gun Chicago democrats. Hoffman, a down-state democrat, has been a supporter of Illinois gun owners but for some reason decided to toss the other side a bone. Looks like we got our first floor fight ready. Thursday brought a little different atmosphere. As we headed to the Judiciary Criminal Committee. There our bills were pending in the sub-committee on firearms. With four of five members present, our bills were called. HB-403 - Jones, J, would preempt home rule units of local government from banning or regulating rifles and shotguns in any way beyond those restrictions in 24-3.1 of the deadly weapons code. Passed 4-0. HB-542 - Righter, would require every municipality to forward any and all ordinances pertaining to firearms to the State Police and require the State Police to publish a complied list of those ordinances. Passed 4-0. HB-414 - Reitz, would prohibit any unit of local government from registering firearms or their owners. Passed 4-0. HB-401 - Brunsvold, the right to carry bill was discussed and debated for about 10 minutes before being voted out 5 to 0. While our opponents continue to wring their hands over access to firearms and people running amuck killing each other if this bill should pass, the committee clearly saw through the rhetoric. As we kept our remarks short, to the point and to the contents of the bill, we fielded questions from committee members refuting the assertions espoused by ICHV. Normally, sub-committees are used to kill bills off. But this committee was made up of pro-gun legislators, it seemed that things were a little different. Then we got to pop a little surprise on the anti-gun crew and the city of Chicago. HB-482 started off being a preemption bill for all firearms. Late Wednesday, we filed an amendment and the committee accepted it. The amendment did two things. One was to move the preemption clause out of the FOID card act and put it in the deadly weapons act under 24-3.1. The preemption clause was also for concurrent preemption. Meaning that the municipalities could regulate firearms, but only as described in 24-3.1. They could duplicate state law, but not go past it. They could prohibit felons, drug addicts and the like from possessing guns, but that's all. The real kicker for the amendment came with a new act to license gun dealers. Unlike Daley's bill, this amendment mirrors the federal license requirements and rules. It does not contain the warrantless searches, registration and the other goofy stuff Daley has tried to hide in his bill behind the cloak of "licensing gun dealers". So this puts a bunch of anti- gun types in a trick bag. They can vote for licensing gun dealers - our way, and thus give us preemption. Or they can vote against the bill, and suffer all the public criticism about how they voted against licensing gun dealers. The same thing the Dems pulled on republicans last fall. Many of our suburban supporters who took it on the chin in the last election for voting against Daley's package, will be able to hold out a vote for licensing gun dealers, all the while voting for preemption. The City did not get a chance to see the amendment before hand, and while still opposed to it, got caught with their pants down. The anti-gunners and a few others are going to have a bunch of explaining to do as they will have to argue against the licensing of gun dealers. It should prove to be interesting as we hopefully will have them caught in the switches. They will be forced to argue or at least have to explain why they feel the need for warrantless searches, registration and the other hidden dirty tricks they have attempted to pass under the guise of licensing gun dealers. Next week we will have the show down over the Daley gun bills. Rep. Hoffman remains the key player in this. If he stays on the committee, we should be able to kill the bills. If they replace him, the bills will be headed to the floor for a fight. Later next week we should also see the Right to Carry bill come out of committee along with the rest of the pro-gun bills in the Jud 2 committee. The senate is out next week, so we get a bit if a rest. If you have time, come by the capitol this week. We have been warned that the Jud 1 committee may meet twice so no one knows when the bills will be called, whether it would be Wednesday morning or another time.
