The Food and Drug Administration called on pharmaceutical companies to apply for licenses to market 500-milligram pills of Prussian blue, or ferric hexacyanoferrate(II), saying it "has been shown to be safe and effective in treating people exposed to radioactive elements such as cesium-137." Health and Human Services Secretary Tommy Thompson said the action was part of an effort to boost production of drugs that could be used in the event of another terrorist attack, especially one involving radioactive materials. The FDA said Prussian blue, which binds with radioactive particles and expels them from the body, would be the first therapy available to decr- ease radiation exposure. The main side effects were constipation and stomach upset. It said the drug could be used to treat patients with known or suspected internal contamination with radioactive thallium, non-radioactive thallium, or radioactive cesium. FDA said cesium-137, found in the fallout from the detonation of nuclear weapons and in the waste from nuclear power plants, was of particular concern because it could potentially be use to build a dirty bomb. Seems really weird to me that we would all take ink pills and have that bind to cesium and carry it out of our bodies. B One of his earlier books has several examples on how high doses of Vitamin C make people much less subject to harm from radioactivity. After all Vitamin C is a splendid anti-oxidant and most of the harm from radioactivity comes from oxidation in various ways. B > Do you remember that story in readers digest about some person in China sick with some affliction and they couldn't figure it out? The story was posted to the internet and a bunch of doctors were emailing the person what to do to treat it? Turned out someone was trying to kill that person and the US doctor who figured out the symptoms remembered about Prussian Blue and told the Chinese person (or their doctor I don't remember which) to take it since the method of killing was slow administration of radioactive materials internally (through poisoned food or drink or something). In addition to Vitamin C , you want to take a good dose of OPC or oligomeric proanthocyanadin. It is a much stronger anti oxidant and works very well with Vitamin C, Vitamin E, etc. The most common sources of OPC are grape seed extract and a certain pine bark (aka pycogenol when extracted as an OPC). (Think about the purported benefits of red wine.) Grape seed and other OPC pills are good. (Probably the best OPC product is a powder mixed with water to make it isotonic for better absorption called OPC-3 -- ask me privately about it). Anyway, good Vitamin C and OPC and Vitamin E and other (like Selenium) anti-oxidant intake can help you a lot in the health arena... It's a simple little test that will only require they formally lend their name to that which they say they profess. A few days ago, Rep. Joe Wilson (R-SC) introduced H.R. 648, a bill: "To protect the right to obtain firearms for security, and to use firearms in defense of self, family, or home, and to provide for the enforcement of such right." The bill is rather straightforward. In short, it states that: "A person not prohibited from receiving a firearm by Section 922(g) of title 18, United States Code, shall have the right to obtain firearms for security, and to use firearms -- in defense of self or family against a reasonably perceived threat of imminent and unlawful infliction of serious bodily injury; in defense of self or family in the course of the commission by another person of a violent felony against the person or a member of the person's family; and in defense of the person's home in the course of the commission of a felony by another person." The bill also gives a citizen recourse if refused "permission" to purchase or own a weapon: "A person whose right under subsection (a) is violated in any manner may bring an action in any United States district court against the United States, any State, or any person for damages, injunctive relief, and such other relief as the court deems appropriate." Attorneys fees may also be awarded to a prevailing plaintiff. Along with attempting to change the law favorably, the body of the bill also presents some facts that could also be useful in forming arguments against local gun- grabbers. For instance, in the "Findings" section, Rep. Wilson includes some surprising statistics: (1) Police cannot protect, and are not legally liable for failing to protect, individual citizens, as evidenced by the following: (A) The courts have consistently ruled that the police do not have an obligation to protect individuals, only the public in general. For example, in Warren v. District of Columbia Metropolitan Police Department, 444 A.2d 1 (D.C. App. 1981), the court stated: '[C]ourts have without exception concluded that when a municipality or other governmental entity undertakes to furnish police services, it assumes a duty only to the public at large and not to individual members of the community.' (B) Former Florida Attorney General Jim Smith told Florida legislators that police responded to only 200,000 of 700,000 calls for help to Dade County authorities. (C) The United States Department of Justice found that, in 1989, there were 168,881 crimes of violence for which police had not responded within 1 hour. (2) Citizens frequently must use firearms to defend themselves, as evidenced by the following: (A) Every year, more than 2,400,000 people in the United States use a gun to defend themselves against criminals -- or more than 6,500 people a day. This means that, each year, firearms are used 60 times more often to protect the lives of honest citizens than to take lives. (B) Of the 2,400,000 self-defense cases, more than 192,000 are by women defending themselves against sexual abuse. (C) Of the 2,400,000 times citizens use their guns to defend themselves every year, 92 percent merely brandish their gun or fire a warning shot to scare off their attackers. Less than 8 percent of the time, does a citizen kill or wound his or her attacker. (3) Law-abiding citizens, seeking only to provide for their families' defense, are routinely prosecuted for brandishing or using a firearm in self-defense. For example: . . . (4) The courts have granted immunity from prosecution to police officers who use firearms in the line of duty. Similarly, law-abiding citizens who use firearms to protect themselves, their families, and their homes against violent felons should not be subject to lawsuits by the violent felons who sought to victimize them. So there you have it. The bill is crafted in such a way that even moderates in Congress should agree. Sure, many of us can argue that the bill does not go far enough. Even so, this bill is worth working to get passed. And here's our little test: Anyone not agreeing with the self-defense of self, family and home against a violent felon simply has no business being in government. In this case, our argument is outlined for us within the bill itself. So, let's work to have our representatives sign on to H.R. 648 and vote in favor of it when it gets to the floor. DRUG TREATMENT AND CHILDREN Buried deep within H.J.RES.2, a Joint Resolution making further continuing appropriations for fiscal year 2003, are all sorts of interesting spending projects, few of which are authorized to the federal government by the Constitution. For instance, they appropriated $418,773,000 for carrying out section 301 and title IV of the Public Health Service Act with respect to alcohol abuse and alcoholism. Another $3,129,717,000 is appropriated for program management of the Mentally Ill Individuals Act and they targeted $12,000,000 to carry out data collection activities supporting the annual National Household Survey. Over and above that will come the new Bush bills to finance alcohol and drug abuse treatment in the private sector -- which is expected to cost taxpayers billions of bucks each year. Few Americans question treating the mentally ill, alcoholics and drug abusers. The problem is, when did that become the purview of the national government? Fact is, it is not. Later, when we went looking for how some of this treatment money is spent, an appalling situation glared out from the reams of information located: Apparently, federal tax dollars are spent to provide heavy duty psychiatric drugs to children -- often just to calm minor behavior problems. A Jan. 14 front page article in The Washington Post titled, "More Kids Receiving Psychiatric Drugs," by Shankar Vedantam, identified part of the problem: "The number of American children being treated with psychiatric drugs has grown sharply in the past 15 years, tripling from 1987 to 1996 and showing no sign of slowing, researchers said yesterday," Vedantam reported. "A newly published study, the most comprehensive to date, found that by 1996, more than 6 percent of children were taking drugs such as Prozac, Ritalin and Risperdal, and the researchers said the trajectory continued to rise through 2000. "The new research found steep increases in the use of most classes of medicines, including antipsychotic drugs. Such powerful medications, normally meant to treat schizophrenia, were increasingly being prescribed to children on Medicaid, said the study's lead author, Julie Zito -- possibly as a way to restrain difficult children." Zito reports that, between 1987 and 1996 the number of children prescribed psychiatric drugs has skyrocketed: children were being prescribed drugs such as Prozac, Ritalin and Risperdal -- without a clinical rationale for prescribing any particular drug, and the trajectory continued to rise through 2000. (1) "Other than zonking you, we don't know that behavioral management by drug control is the way to learn to behave properly," said Zito, a researcher at the University of Maryland in Baltimore. "If we are using drugs to control behavior, that doesn't change the underlying problem if someone doesn't know how to get along with their peers." The important point is, Medicaid (our tax dollars) is being used to pay for the inappropriate drugging of children -- over 900,000 kids in just two Northwest states, according to the study. Why such an appalling increase these past few years? A large number of these over-medicated children will later self-medicate and become alcohol and drug abusers as adults. Which means that federal funding for substance abuse treatment programs will also be increasing over the years. We think some federal money should be spent on this topic. For sure, some should! Because, something is definitely wrong with this picture. But, what is needed is a far reaching research study to find out exactly what the hell is going on here and who is responsible for this ridiculous situation. 1.) http://www.researchprotection.org/infomail/0103/14.html THEY'RE THE ENEMY, STUPID [NOTE: While researching material for an article on how the Clinton Administration provided North Korea with food and goods -- which allowed North Korea to continue building its military forces -- I stumbled on this article I published on August 22, 1997 in issue #49. Everything in it is still applicable. So, here it is again.] The national media is throwing a sob story at us again. It's the same one they tried last spring: North Korean children are starving, and somehow it's our fault. It's not our fault, though. They have land. They know about farms and gardens. They have seeds. And if they used their money to build more tractors instead of military equipment, they would also have food. The major media would have us believe that we should send them more food. We did send food. Most of it went to the military -- the very same military who are still pointing guns at the Americans stationed in South Korea. Worse yet is what the American media fails to tell us. London's "Electronic Telegraph" reported this week that "North Korea is producing 15 tons of chemical weapons each day for use against South Korea, according to the latest analysis of its war arsenal." The Telegraph said that: "It now has a stockpile of 1,000 tons, 70 tons of which could be used immediately in an attack on Seoul, leading to full-scale war, South Korea's Chiefs of Staff say in a report." Apparently they have eight chemical weapons factories with a combined capacity of producing up to 40 tons of chemical weapons a day. North Korea has the long-range field pieces and missiles necessary to deliver the chemical weapons, too. They could lob them right over, on top of our American military personnel, with ease. Yet, not one word about this by the American media. Instead, they show us pictures of emaciated children. Instead, they would have us send food to North Korea, so North Korea may better afford to spend even more money on weapons. All the better to kill the American military with, evidently. Because, in case anyone forgot, we're their enemy. Starvation is a bad thing, to be sure. But so is war. We can do the humanitarian thing and feed them. But, we should demand something in return. Like all of their weapons. Line up the barges full of food in the ocean. When they start passing out the guns, we can start passing in the food. Nothing short of that will act to protect our military forces and allies stationed in South Korea. And regardless of what the major media tries to imply, our American military people, and allies, must always be our country's first responsibility. NOTES ON THE CONSTITUTION As the federal government goes about its unassigned function of regulating every aspect of the life, liberty and property of American citizens, we sometimes point to the Bill of Rights for protection. So, herein we excerpt a passage from The Federalist Papers #84, written by Alexander Hamilton. This excerpt is worth reading, and studying. It tells the forgotten story of the American Rule of Law. And it also points out that it is time We the People have a little job description discussion with our servants in government. "I go further and affirm that bills of rights, in the sense and to the extent in which they are contended for, are not only unnecessary in the proposed Constitution but would even be dangerous. They would contain various exceptions to powers which are not granted; and, on this very account, would afford a colorable pretext to claim more than were granted. The TSA will be screening to make sure that AIRLINE PILOTS CAN "CONDUCT THEMSELVES WITH MAXIMUM REGARD FOR THE SAFETY AND SECURITY OF THE TRAVELING PUBLIC, CREW AND FAMS..." No kidding. 4) A very probing, intrusive and exhaustive government sponsored background investigation to include an "interview" with a TSA "security expert." They will call a pilot's neighbors, friends, relatives, co-workers, previous employer and, in direct violation of the law, THEY WILL ASK HIS OR HER CURRENT AIRLINE EMPLOYER IF THEY THINK THE PILOT SHOULD BE ALLOWED TO PARTICIPATE IN THE FFDO PROGRAM. Considering the airlines' longstanding and clear opposition to this program, what do YOU think the answer might be? 5) A medical evaluation. Apparently existing FAA exams required every six months are inadequate for the TSA. 6) TSA agents will be skulking around FFDO training facilities with pencils and notepads OBSERVING THE BEHAVIOR OF FFDO STUDENTS DURING THEIR FIREARMS TRAINING and making sure they have the proper "mindset." Stand by for a hostile training environment. 7) ANOTHER "psychological assessment" after training is completed. Look forward to another TSA sponsored psychiatric grilling. In addition, the TSA-proposed firearms carry method is unacceptable. The time-proven method, the one that is the safest and most secure way of transporting a firearm, is for the individual responsible for the firearm to carry it on his person. The TSA is not planning to allow this for FFDO's BECAUSE THEY WANT TO MAKE THIS PROGRAM AS CUMBERSOME, UNMANAGEABLE, UNWIELDY AND AS EXPENSIVE AS POSSIBLE, in order to minimize the number of pilots that volunteer, and to doom the program to failure even before it starts. GUNS IN UNATTENDED LOCK-BOXES OR IN UNSECURED CREW LUGGAGE WILL PUT ALL PILOTS IN JEOPARDY AND MAKE OUR TRANSPORTATION SYSTEM LESS SAFE, but these facts conflict with the TSA's true agenda: To scuttle the FFDO program. A TSA attorney-advisor, Mr. Stephen L. Cohen, has made it clear that the TSA intends to make the program so difficult, intimidating and burdensome that no pilot will volunteer. "Courts have settled this key issue in other jurisdictions, and now it's settled in this jurisdiction. Social workers cannot enter a home, willy-nilly, without a warrant," said Gary McCaleb, an attorney with the Alliance Defense Fund, the national legal organization based in Scottsdale, Arizona, that supported the case. Paul and Linda Walsh filed a lawsuit after police and caseworkers entered their home without a warrant and without permission. The social workers said they were acting on an anonymous tip about unspecified "hazards" in the home, and claimed they had a right to enter the home without a warrant. The social workers threatened the family, saying that if they were not allowed in the home they would take the children away from the parents. In papers filed with the court, the Walshes said that a social worker even blocked their driveway with her car when the family tried to leave to attend a church function that evening. The social worker summoned police, who frisked Mr. Walsh and threatened to arrest him on charges of obstructing official business if he did not allow the caseworkers into the home. Walsh said that he then allowed the workers to enter the home rather than risk being jailed. The caseworkers found nothing in the home that constituted an immediate hazard to the family. Instead of tolerating this official abuse, the Walshes chose to sue the caseworkers, the Erie County Department of Job and Family Services, the Erie County Board of Commissioners, the City of Vermilion, Ohio; and three Vermilion police officers. Defendants told the court that the Fourth Amendment prohibitions against illegal searches and seizures do not apply to them in such circumstances. They asked the court to throw the case out, but the court refused. The court said the facts supported the Walshes' claims against the defendants for unreasonable searches and seizures, as well as for false imprisonment, assault, battery, and infliction of emotional distress. In a forceful opinion, US District Judge James G. Carr wrote: "Despite the Defendants' exaggerated view of their powers, the Fourth Amendment applies to them, as it does to all other officers and agents of the state whose requests to enter, however benign or well-intentioned, are met by a closed door. There is...no social worker exception to the strictures of the Fourth Amendment. ...Any agency that expects to send its employees routinely into private homes has a fundamental obligation to ensure that those employees understand the constitutional limits on their authority." The court stated that because the Walshes refused consent, and because the anonymous complaint did not supply persuasive evidence of an emergency, the caseworkers had no option but to either "leave the [Walshes] alone and in peace" or seek a search warrant. The court further ruled that the police did not have probable cause to detain, frisk, and threaten to arrest Walsh, since he was not breaking any law but merely asserting his "fundamental right to be left alone." Kurt D. Anderson, a partner with the Elyria firm of Fauver, Keyse-Walker & Donovan, represents the Walshes. Anderson, a graduate of Alliance Defense Fund's second National Litigation Academy, said the training gave him the background to help the Walshes when the opportunity arose. "ADF's training and resources really helped us confront an issue that, unfortunately, had apparently never been addressed in Ohio before," Anderson said. "As far as we could tell, nobody in Ohio had ever challenged a caseworker's home inspection for failure to get a warrant. As a home schooling parent myself, I really took the Walshes' situation to heart. I admire them for their courage to stand up for their rights, but it's a crying shame that it would even have to come to that. It's just a reminder that we have to be vigilant and assertive about protecting our rights. They can be trampled on even by well-meaning but uninformed government agents." Anderson expects that as a result of the Walsh case, training policies will be revised for social workers not just in Erie County, but across the state of Ohio. "The caseworkers in the Walsh case admitted they had never been taught anything about the Fourth Amendment or search warrants. The feedback I'm getting is that agencies across the state have gotten a wake-up call on this issue." Anderson declined to reveal the specific amount of the settlement, which was not stated in the court record. The court's 8-1 ruling applies to protests of all sorts, not just at abortion clinics. Chief Justice William H. Rehnquist, writing for the majority, said that when protesters do not ``obtain'' property, they cannot be punished under federal extortion laws. The court's ruling is a victory for Operation Rescue, anti-abortion leader Joseph Scheidler and others who were ordered to pay damages to abortion clinics and were barred from interfering with their businesses for 10 years. The ruling ends that injunction. Rehnquist said their protest activity did not qualify as extortion. That outcome had been sought by activists like actor Martin Sheen, animal rights groups and even some organizations that support abortion rights. They argued that protesters of all types could face harsher penalties for demonstrating, if the court ruled otherwise. The demonstrators had been sued in 1986 by abortion clinics in Delaware and Wisconsin and the National Organization for Women, which contended that racketeering and extortion laws should protect businesses from violent protests that drive away clients. They accused the groups of blocking clinic entrances, menacing doctors, patients and clinic staff, and destroying equipment during a 15-year campaign to limit abortions. The demonstrators were ordered to pay about $258,000 in damages. Rehnquist said there is no dispute that abortion protesters interfered with clinic operations and in some cases committed crimes. ``But even when their acts of interference and disruption achieved their ultimate goal of 'shutting down' a clinic that performed abortions, such acts did not constitute extortion,'' he wrote. The punishments were meted out under provisions of the 1970 Racketeer Influenced and Corrupt Organizations Act, known as RICO, and the Hobbs Act, a 1946 law aimed at crushing organized crime. The Hobbs Act makes it a crime to take property from another with force. Justice John Paul Stevens filed the only dissent. He said the court was limiting the scope of the Hobbs Act and limiting protection of property owners in its ``murky opinion.'' The Supreme Court has previously said that the Hobbs Act should be read broadly, he said. ``The principal beneficiaries of the court's dramatic retreat from the position that federal prosecutors and federal courts have maintained throughout the history of this important statute will certainly be the class of professional criminals whose conduct persuaded Congress that the public needed federal protection from extortion,'' Stevens wrote. Justice Ruth Bader Ginsburg wrote separately to say that the court was ``rightly reluctant'' to extend the reach of the RICO law, which allows prosecutors and private groups to seek hefty penalties. In 1998, a jury in Illinois found demonstrators guilty of dozens of violations, including four acts involving physical violence or threats of violence. The court did not address a related issue in the case over whether the racketeering law gives individuals the right to ask a federal judge to stop a disputed activity. The law is most often used by federal prosecutors to go after organized crime figures, alleged conspirators and other criminals. The cases are Scheidler v. National Organization for Women, 01-1118, and Operation Rescue v. Worden U.S. threatens to sue state for using gun database Justice Dept. wants only dealers, not cops, to have access Robert Salladay, Chronicle Sacramento Bureau Friday, February 28, 2003 Sacramento -- The U.S. Department of Justice has threatened to criminally prosecute California's top firearms official over the state's continued use of a federal databank to hunt down illegal gun users, The Chronicle has learned. The threat marks a significant escalation in the war between California law enforcement and U.S. officials over gun control and background checks. State officials said that until John Ashcroft became U.S. attorney general in 2001, California's use of the databank was not questioned. Federal authorities believe the list of convicted felons, drug dealers, suspected terrorists, spouse beaters, illegal immigrants and others should only be used to help gun dealers determine if someone is allowed to buy a gun, not police investigating other gun-control violations. Gun-control advocates say it's part of a pattern. "At a time when Ashcroft is pushing for maximum police powers in almost all areas of our lives, the one exception is guns," said Luis Tolley, Western regional director with the Brady Campaign to Prevent Gun Violence. "They are going in the opposite direction." Now, in an unprecedented action, the chief of California's firearms division says he was threatened with federal action for a criminal violation if California continues to use the federal database to search for illegal gun users who violated the law in other states. "We understood it as a potential criminal action," said Randy Rossi, firearms chief for state Attorney General Bill Lockyer, "and our response back to them was we understand what you are saying and we think public safety is paramount and you take whatever step is necessary." If U.S. authorities deny access to some of the FBI's computers, state officials believe they will be forced to return guns to violent criminals. Thousands of background checks would be prohibited every year, state officials said. THREAT CAME IN CALL Lockyer's office said the threat of legal retaliation came from an attorney in the FBI's Criminal Justice Information Services Division during a conference call several weeks ago with Rossi and other California officials. U.S. Sen. Dianne Feinstein, D-Calif., has requested an explanation from FBI Director Robert Mueller on what she called a restrictive interpretation of the law that overturns a "long-standing history of conducting such checks." The FBI wrote back acknowledging there were differing opinions and promised a further review by U.S. Department of Justice attorneys. Spokesmen for Ashcroft, who controls the FBI, did not return a call seeking comment. The central dispute is over California's use of the National Instant Criminal Background Check System, or NICS. The computer system was installed in 1998 to allow firearms dealers to check, supposedly within 30 seconds, whether someone is prohibited from owning a gun. The state uses the system to conduct background checks for the gun dealers but also to determine if a confiscated weapon should be returned or if someone has a large number of illegally owned firearms. California has its own databank of people prohibited from owning guns. But law enforcement also checks NICS to see if a suspect has legal problems in other states. Lockyer's office checks the NICS nationwide system about 5,000 times a year on behalf of police, sheriffs and their own investigators. DATA FROM OTHER STATES A suspect may be clear in California but convicted of offenses in another state or federal court, but law enforcement would not find that out in many cases, gun-control advocates and state officials fear. "There needs to be one central depository of felonies, of people who are prohibited, the mentally disturbed and the like," said Tolley with the Brady Campaign. California officials believe Ashcroft and the FBI are intent on scuttling a new state law that allows Lockyer to investigate people who may illegally have large stores of guns that are being undetected. The so-called armed and prohibited law targets people recently rejected for gun ownership during a background check because they have a criminal record or arrest. Rather than stopping there, Lockyer's office is using a newly created state database and three separate federal databases to look for past gun purchases in other states -- and then going after those guns. OFF-LIMITS TO STATE Ashcroft's office has told Lockyer that all three federal databases -- NICS, the National Crime Information Center and the Interstate Identification Index -- are off-limits to his agents if they are using them for the armed and prohibited program, state officials said. For regular criminal background checks outside of the armed and prohibited program, federal authorities are allowing California access to two of the databases. But they want to deny Lockyer's office access to NICS, unless the state is making a background check for a gun dealer or pawn shop. State authorities say they like using the more convenient NICS system because it contains all the information from the two other criminal databases under federal control, as well as unique information that other databanks do not track. The NICS-only information includes the names of illegal immigrants, possible terrorists, people classified as mental defectives or who have renounced their citizenship, people dishonorably discharged from the military, and convicted drug addicts or dealers. PUSHING POLITICAL POINT Gun-rights supporters believe Lockyer, a Democrat who plans to run for California governor in 2006, is pushing the issue to make a political point and highlight the differences between the Bush administration and his own record on gun control. The National Rifle Association said the NICS databank appears clearly designed for use by gun dealers, not for police investigating crimes. The other databanks, they said, can be used to track down criminal records in other states. "It seems to me that they are trying to make this into a political issue," said Andrew Arulanandam, NRA spokesman. Georgia officials say they also have been threatened by federal authorities over interpretation of U.S. law concerning criminal background checks. Georgia was denying gun purchases to people arrested for crimes but not charged or convicted. In a letter last year to the Georgia Bureau of Investigation, the FBI warned that the 1993 Brady Handgun Violence Protection Act and Georgia law do not allow "naked arrests" without an indictment or conviction to be used to deny a gun purchase. The FBI said it was "very interested in the status of any corrective action." Georgia complied with the FBI, and the number of firearms denied to suspected felons dropped significantly. The Atlanta Journal-Constitution estimated that every day an average of 17 or 18 people facing felony charges now are given permission to buy a gun in Georgia. "We viewed it as a threat," John Bankhead, spokesman for the Georgia Bureau of Investigation, said about the FBI's letter. "We had done this for six years without an issue until the new administration came in, and they pulled this on us."
