All,
Here's a new one on me. The Congress changed the Constitution by an Act
of
Congress, without an amendment, when it restricted the House of
Representatives to 435 members, thus setting up the ludicrous ratio of
"representation" that we have currently (at least in Washington state's
1st
District) of some 660,000 to one "representative", I believe -- over
twenty
times the ratio specifically prescribed by the Constitution. Am I
missing
something here? Surely this matter has not been overlooked for over 70
years. "Taxation without representation" rides again! ;-) ICE

Article I, section 2, clause 3: states among other things: "The Number
of
Representatives shall not exceed one for every thirty Thousand". And by
the act of congress of June 18, 1929, it restricted the size of the
House
of Representatives to 435. 46 Stat 26, 22 as amended by 55 Stat 761

>From the US CONSTITUTION ANNOTATED, a document of some 2700+ pages
complied by the Congressional Research Service:
Ultimately, by the act of June 18, 1929, it provided that the membership
of
the House of representatives should henceforth be restricted to 435
members, to be distributed among the states by the so-called ''method of
major fractions,'' which had been earlier employed in the apportionment
of
1911 and which has now been replaced with the ''method of equal
proportions.'' Following the 1990 census, a State that had lost a House
seat as a result of the use of this formula sued (see footnote below),
alleging a violation of the ''one person, one vote'' rule. Exhibiting
considerable deference to Congress and a stated appreciation of the
difficulties in achieving interstate equalities, the Supreme Court
upheld
the formula and the resultant apportionment.
FOOTNOTE: U.S. Department of Commerce v. Montana, 112 S.Ct. 1415
(1992).
The practice of the Secretary of Commerce in allocating overseas federal
employees and military personnel to the States of last residence was
attacked but upheld in Franklin v. Massachusetts, 112 S.Ct. 2767 (1992).
The mandate of the clause of an enumeration of ''their respective
numbers''
was complied with, it having been the practice since the first
enumeration
to allocate persons to the place of their ''usual residence,'' and to
construe both this term and the word ''inhabitant'' broadly to include
people temporarily absent.

Is that written in the Constitution itself? Do you have a specific

New York offers $500.00 Reward:
Turn In Your Gun Owner Neighbors!
from Cliff
defender@rovin.net
February 1, 2001
Dear Civil Rights Defender,
After seeing some literature reminiscent of a Nazi Germany type "turn in
your neighbor" policy at a New York City Community Council meeting last
week, I have finally obtained documentation from one of my NYC PD inside
contacts. What follows below is the official Police Department City of
New
York Auxiliary Police Section A.P.S. Bulletin # 001 January 12, 2001
Subject: Auxiliary Police Participation "Operation Gun Stop which
follows
directly from the official Chief of Department Memo #1, Subject:
Operation
Gun Stop, cs 01-12-01.
Please see the fully transcribed copy of the document, "Operation Gun
Stop"
below. If you wish to see a photocopy of the actual document, click
here.
The effect of the New York City policy, as directly quoted from the
document, is that:
"... private citizens will be able to anonymously provide this
Department
with information regarding individuals or locations involved with
illegal
handguns. Individuals who provide information that leads to an arrest
for
such sale/possession will be eligible for a cash reward of $500. ..."
As this demonstrates, individuals can secretly make the accusation, the
police will perform the raid, and YOU will be arrested. You will NOT be
able to face your secret accuser. Your accuser may NOT even have any
real
knowledge substantiating his claim. But, that does NOT matter. We are
ALL
hostage to the whim of our neighbors -- just like in an oppressive
totalitarian regime we live in fear if we exercise our now impotent
rights!
This new initiative will be a widespread, well funded operation seeking
to
enlist the participation of as many residents as possible. There will be
a
variety of promotional literature posted and handed out in the community
as
well as at public city events. There will be advertising, as well. The
city
is serious about the recruitment of New Yorkers to turn in their
neighbors
in order to eradicate non-registered gun ownership.
Additionally, I do NOT recall that the literature that I read at the New
York City Community Council meeting last week limited the program to
hand
guns only! Any secret accusation will cause the police to come into your
home. Anything that they find that is NOT in perfect COMPLIANCE with the
myriad of confusing laws will result in an arrest and confiscation. This
does NOT just apply to handguns! The "Operation Gunstop" is just an
excuse
to enter and search your premises.
Just remember what has been happening in Connecticut since their "danger
to
oneself/public/firearms" snitch law went into effect in October 1999.
All
neighbors with a grudge against you have to do is call the police
claiming
that you are acting "odd" and that they "feel" that you may be a danger
to
yourself. The police will promptly come and confiscate your legally
owned
firearms. Good luck getting them back.
I will have to wait until the complete package of literature arrives
before
I can be sure that the city will be encouraging its own citizens to turn
in
their neighbors who may own ANY type of firearm.
Please read on below, and use the links provided to make contact with
the
appropriate officials to express your opinion of this program. Thank
you.
With Liberty,
Cliff

Text of Actual Government Memo
POLICE DEPARTMENT
CITY OF NEW YORK
AUXILIARY POLICE SECTION
A.P.S. BULLETIN # 001 JANUARY 12, 2001
SUBJECT: AUXILIARY POLICE PARTICIPATION "OPERATION GUN STOP"
1. As part of our Department's Policing NYC:2001 strategy, "Operation
Gun
Stop" has been created whereby members of the public will be encouraged
to
participate in our effort to combat illegal sale and/or possession of
handguns. Under this program, private citizens will be able to
anonymously
provide this Department with information regarding individuals or
locations
involved with illegal handguns. Individuals who provide information that
leads to an arrest for such sale/possession will be eligible for a cash
reward of $500. Auxiliary police officers while performing patrol and
community activities are in a key position to convey this invaluable
information to private citizens in their community and accordingly have
been requested to assist in this endeavor.
2. Auxiliary police officers have been requested by both the Chief of
the
Department and Chief of Patrol to participate in disseminating
information
to the general public regarding "Operation Gun Stop". To begin,
auxiliary
police coordinators are to immediately confer with their Commanding
Officer
and or Executive Officer for instruction relative to their individual
command's strategy for utilization of auxiliary police officers in
distribution and dissemination of information to the public. In order to
promote the GUN STOP initiative, auxiliary police coordinators shall
then
be responsible to ensure that their auxiliary police personnel are
informed
of and distribute informational material (flyers, posters, and cards).
Refer to instructions as per CHIEF OF DEPARTMENT MEMO #1, Subject:
Operation Gun Stop, cs 01-12-01.
3. All commands will receive "Operation Gun Stop" informational
materials
which include 3 1/2" x 4 1/2 "cards, 8 1/2 x 11" flyers, and 11" x 17"
posters. All auxiliary police coordinators shall acquire these materials
from their command and or the borough auxiliary police coordinator for
distribution by auxiliary police personnel. Members of the Auxiliary
Police
Program should take advantage of any contact(s) with the public, to make
citizens aware of "Operation Gun Stop". Auxiliary police officers may
distribute these materials to the public while on patrol and or at
special
events and details, recruitment drives, street fairs, and community
meetings, etc.
4. All auxiliary police coordinators and auxiliary police commanding
officers shall make "Operation Gun Stop" strategy their priority and
ensure
that all auxiliary police assigned are familiar with it's goals and are
actively participating.
5. For your information and compliance. Angelo J. Maroulis Captain cc:

Columbine Parents: Cops Shot Our Son
Thursday, February 1, 2001 - Associated Press
http://www.foxnews.com/national/columbine/index.sml
The autopsy done on a Columbine student whose parents claim he was shot by
sheriff's deputies shows that two bullets entered his chest and abdomen, with
one resting in his body and the other exiting through his back.
Oct. 2, 2000: Rich Petrone, whose stepson Danny Rohrbough was killed during
the Columbine shootings, speaks in Golden, Colo.
Daniel Rohrbough's parents allege student gunmen Dylan Klebold and Eric Harris
could not have shot their son from the front because witnesses saw Daniel running
from the gunmen.
"The only other people with guns that day were law-enforcement officers," said Jim
Rouse, the parents' attorney. Jefferson County spokeswoman Jennifer Watson said
the county would not comment.
Rohrbough and Daniel's mother, Sue Petrone, are suing the Jefferson County
Sheriff's Office and others, claiming the deaths at Columbine could have been
prevented. Daniel's autopsy, released Wednesday to fulfill a judge's order, showed
that the 15-year-old died of extensive injuries to his chest resulting in excessive
bleeding.
The autopsy also showed Daniel was shot in the leg during the April 20, 1999,
attack when Harris and Klebold killed 12 students and a teacher in the nation's
worst school shooting before taking their own lives.

I used keyword "firearm" to search the Senate bills, and got 44 hits - a
few of them are
pretty obviously not firearms-related (one had the BATF name spelled out in
full in a
tax bill, for instance), but most were.
Pretty much a laundry list of anti-gun bills...where the hell are the
Republican-submitted
bills to repeal the Brady Act, GCA 68, etc.? It can't hurt to submit them,
and waste the
time of the anti-gunners in the various committees, they way they submit
anti-gun bills
and wast the time of everybody else in the committees.
Searching the House bills returned 96 hits - at least there were some
recognizable pro-gun
bills in that list...plus some real pieces of Sarah Brady wet-dream
crap...sheesh...
Then there was this one; what the heck is this about?:
For the relief of Herman J. Koehler, III.

+ Breaking News: Misfire on NEA Gun Control Petitions? The 2000 NEA
Representative Assembly required union headquarters to disseminate petitions
calling for "meaningful gun control," to gather them together by January 15,
2001, and to deliver them to Congress no later than February 1, 2001. Did you
see the petitions delivered on the evening news? Did you read about it in the
New York Times or Washington Post? Did the NRA release a statement denouncing
the effort? No? That's because NEA is still gathering petitions, now more
than three weeks past the deadline. NEA Communications is in the process of
passing details to EIA as this communiqu goes to press.
EIA has heard anecdotal evidence that ad hoc efforts by gun-owning NEA
members had a detrimental effect on signature-gathering in a number of
states, but there is no clear sign of how widespread such efforts were, or
whether they have any relation to the delay. When NEA delivers the
information, EIA will, as a matter of course, pass it on to you.
+ NEA-Alaska, Staff Reach Tentative Agreement. NEA-Alaska and its staff
union reached a tentative agreement on a four-year contract, effectively
putting an end to the nearly three week long strike by union employees.
Details of the terms are as yet unavailable. The staff union easily won the
propaganda war, getting a letter from receptionist/secretary Kimila Cherry
published in the Anchorage Daily News. Ms. Cherry, who was hired four months
ago by NEA-Alaska, told readers she makes $21,500 a year and that the
NEA-Alaska contract proposals "would push my family back onto public
assistance." Well, Ms. Cherry is no doubt accurately describing her personal
situation, but it bears noting the average NEA-Alaska support staffer
(secretaries, receptionists and other low-level assistants) made $44,425 in
1995. Either Ms. Cherry is being robbed, or she's due for a big raise pretty
soon, new contract or not.
The next staff union hijinks will likely occur once again in California,
where the California Teachers Association and its staff union, the California
Staff Organization, will begin bargaining in April. CSO accepted a one-year
deal last September in order to avoid labor unrest prior to the November
elections.
+ Union, Governor Prepare for Hawaii Strike. "No textbooks, no contract!"
declared Hawaii Gov. Ben Cayetano, reflecting his position that $40 million
proposed for technology and textbooks should take precedence over the
four-year, 22 percent pay hike the Hawaii State Teachers Association is
seeking. "I think it's wrong for educators to hold hostage these basic tools
for learning so that they can get more pay," Cayetano said. "I hope the HSTA
backs off from that position."
HSTA also received bad news from the Democrat-dominated legislature,
which originally was going to produce a budget that included 14.5 percent
raises for all public employee unions. But now, legislative leaders say they
can't produce that amount without cuts elsewhere. In the meantime, HSTA isn't
sitting on its hands. NEA is already asking staffers from affiliates in
Western states to volunteer to work two-week terms in Hawaii if HSTA goes on
strike in the spring.
Though a strike seems unavoidable, there is some sense that this all may
be street theater before the usual solution is invoked. "If it is the policy
of the House to pay as you go and you exhaust the fund balance and you can't
pay HSTA, it forces us into a corner of raising taxes, which a lot of us
don't want," said House Speaker Calvin Say. Translation: We have to pretend
to fight before we surrender or the GOP may pick up another seven seats next
year.
+ Pennsylvania Union Ratchets Up Rally Pressure. The Pennsylvania State
Education Association has been planning its March 4 Rally for Children and
Public Education at the state Capitol in Harrisburg for more than seven
months. Nevertheless, it appears PSEA is less than thrilled with the initial
number of participants. "Some locals have not reported any attendance by
anybody including the local president," PSEA Communications admonished union
activists in an e-mail message. "It appears some of the largest locals never
passed out the fliers we prepared before Thanksgiving!" The union plans to
have rally coordinators contact each local president by mail to increase the
body count.
+ Real World Education Reform Redux. Last November, EIA devoted a large
portion of a communiqu to examining what happens to education reforms after
they are implemented. The evidence suggested that so much effort was expended
in getting reforms passed, that no one had energy remaining to ensure they
were achieving the desired results. Latest case in point: Philadelphia's
staff hiring reform.
Last year, the Philadelphia School District braved union opposition to
include a new contract provision that would allow individual schools to
choose their own teachers, rather than rely on the seniority system. The
Philadelphia Federation of Teachers ultimately acquiesced, but insisted that
such hiring could only be done by committees made up of both teachers and
administrators, and then only after two-thirds of the staff approved. With
those strictures in place, only 44 schools out of 260 even bothered to hold
an election on the idea. And of those 44, only 12 approved it. "I think 12 is
a good amount because we haven't done this before," Marj Adler, the
district's executive director of human resources told Education Week. "This
will enable us to get the kinks out."
+ Utah House Passes Paycheck Protection Bill. The Utah Education Association
had been feeling its oats the last six months, staging a one-day walkout and
demanding higher salaries and smaller classes. Last week, the Utah House
fired back, passing a bill that would ban the automatic deduction of PAC
contributions from the paychecks of public employees. The bill is expected to
easily pass the Senate. UEA is already planning a court challenge if Gov.
Mike Leavitt signs the bill into law.
Such paycheck protection laws in other states have had a dramatic effect
on union PAC contributions, but very little effect on union political
activities. Funds that previously would have gone directly to candidates were
instead applied to independent expenditures, or other "political information"
activities. The end result has made virtually no difference in the political
landscape. Utah, however, may be a different test case because it will be the
first state (to my knowledge) to have both paycheck protection and
right-to-work laws, which means unions will not be able to compel payments in
other forms without the risk of losing members.
+ EIA Archives Repaired, Upgraded. My apologies to those of you who have
been having difficulties wrestling with the EIA Communiqu archives. The
problems have been corrected and you should have no problem with keyword
searches of all EIA bulletins dating back to November 22, 1999 (if you need
something further back, to the origins of EIA on June 22, 1997, please e-mail
EducIntel@aol.com). In addition, you can now call up the text of communiqu s,
by date, directly from the archives index page.
+ Quote of the Week #1. "Personally, I don't think there are bad teachers."
- -- Julie Nau, president of Wake-NCAE, the Wake County affiliate of the North
Carolina Association of Educators. (Raleigh News & Observer, January 31, 2001)
+ Quote of the Week #2. "Some schools are reputed to have gone overboard,
assigning hours and hours of homework, and doubtless they should moderate
their zeal. But the mass emotional appeal of this book seems drawn from a
more insidious source, namely that today's parents cannot tolerate the least
emotional discomfort in their children. The smallest tantrum throws them into
panic. It seems that parents don't want to be parents anymore. It's too
painful to discipline children when we want them to be our friends. The last
thing we want is to alienate' them by insisting that they do their homework.
What many parents and teachers have lost sight of is that the most important
lesson homework teaches is personal responsibility and self-discipline.
Homework is practice for life." -- John D. Gartner, assistant professor of
psychiatry at Johns Hopkins University Medical School, reviewing the book The
End of Homework: How Homework Disrupts Families, Overburdens Children, and
Limits Learning, by Etta Kravolec and John Buell, in the January 22, 2001
issue of National Review.
