There were 232 votes in favor, 189 votes against, with 11 members not voting. (A 2/3 majority was required to pass H.J. Res. 41.) Our fight to lower taxes, however, is just beginning. Shortly after H.J. Res. 41 failed to pass, another constitutional amendment was introduced: H.J. Res. 45 - The Liberty Amendment. This amendment was introduced by Congressman Ron Paul (Texas). Brendon Fearon has been declared a "victim of serio= us crime" by the Home Office counselling service and asked for his views on Martin's release date, The Telegraph can reveal. Martin is serving a lif= e sentence for wounding Fearon and killing his teenage accomplice, Fred Barras, with a shotgun in an attempt to defend his property. The Home Office has ruled that as a "victim" Fearon, who has 34 convicti= ons for burglary, theft and handling stolen goods, and is currently serving = three years for the break-in, must be consulted about Martin's parole. Last night, the consultation decision was criticised by MPs. Ann Widdeco= mbe, the shadow home secretary, said that it was "madness". "Whatever the rig= hts and wrongs about the degree of force Tony Martin used, it's turning comm= on sense upside down to consult a burglar about the liberty of his victim." Gerald Howarth, a member of the Commons home affairs select committee, called it "utter lunacy". "There's no doubt in the mind of the British p= ublic that the criminals in this case are the ones who broke into Mr Martin's premi= ses and the idea that one of them should have any input into his parole what= soever is a farce. "I will be writing to the Home Secretary to ask him to make sure that on= no account should this man's views be taken into consideration." In a leake= d memo last year Tony Blair, the Prime Minister, referred to the Martin ca= se as an example of how the Government was being seen as "out of touch" on law and order. Mr Blair wrote: "The Martin case - and any lack of res= ponse from us that appeared to empathise with public concern and then channel = it into the correct course - has only heightened the problem [of being seen= as out of touch]." Fearon revealed that he had been asked about Martin's pa= role in a letter he sent to the Norfolk farmer. It said: "I have since been visited by the Victim Support Group in relat= ion to my feeling about you gaining parole in the future. I was, therefore, for= ced to think about how remorseful you may be. Judging from the cold words of yo= ur distorted truth in the paper reviews, my thoughts are not overly optimis= tic." Fearon suggests that Martin will only be at peace with himself once he h= as admitted his crimes, adding that he himself has done just that. He says:= "I feel you will gain your sense of truth in time, as you and I know what h= appened that fateful night. Reconciliation will not occur until you face up to y= our doings as I myself have done so." However, Fearon, 30, who was jailed in January last year after admitting conspiring to burgle Martin's home on the night of August 20, 1999, unde= rmines his claim to have come clean by adding: "We was [sic] not there to take = your belongings merely to escape your dogs and didn't mean to be intruders." Referring to Barras, who had 29 convictions for crimes including burglar= y and assaulting police officers, Fearon insists: "Whatever the reason may hav= e been for us being there, that shouldn't have led to a little boy dying a= s there is no making amends for that little boy. "What is so sad is that you haven't even stressed your sorrows for takin= g a human life and given the little boy's family a second thought as they ha= ve received a life sentence which there is no going back from (so sad)." He= ends by saying: "I hope you feel remorse as it's the only way forward." The typed letter was written by Fearon in his cell at HMP Stocken in Leicestershire, only 30 miles from Gartree jail where Martin is held. Ma= rtin, who is appealing his convictions, is understood to have been upset by it= and has not replied. Fearon, whose brother Neil was jailed last year for fiv= e years for cheating elderly women out of =A340,000, was the leader of the exped= ition to raid Martin's farm in the village of Emneth Hungate. Together with anoth= er man, who did not enter the property, Fearon and Barras drove 60 miles from th= eir home in Newark, Nottinghamshire, to the isolated farmhouse hoping to fin= d antiques. Martin, who claimed he was lying in bed upstairs, heard them b= reak in through a window and fired his pump action shotgun repeatedly into th= e downstairs darkness, hitting both intruders. Barras managed to crawl out= side before dying while Fearon staggered to a nearby property where the owner= s raised the alarm. When interviewed by police he changed his story repeatedly rather than a= dmit why they had really been at the house. At Martin's trial a year ago Fear= on claimed that he and Barras had broken into the property "almost accident= ally" while trying to escape the farmer's rottweiler dogs and said that he had= suffered post-traumatic stress as a result of the shooting. A Home Office spokesman said: "Under the Victims' Charter all victims of serious crime are asked to offer their views on the offender's release c= onditions. If particular concerns are raised the offender may be subjected to condi= tions on their parole such as a restriction or exclusion order." All America watched the high-profile trials of McVeigh and Terry Nichols=20 and believed it saw two completely American men, with no foreign=20 connections. But Nichols has a Filipina wife. He met her on an Asian sex=20 tour. Nichols has a very intimate foreign connection. Nichols made many trips to the Philippines and many telephone calls to that= =20 country. His last trip there Nov. 22, 1994, to Jan. 16, 1995 was just three= =20 months before the bombing. After returning to the United States, he began= =20 to call a certain number in the Philippines every other Tuesday morning at= =20 the same time in the morning. One day Nichols could not get through and he= =20 spent 2 1/2 hours starting before sunrise trying to make the call, from=20 outdoor phone booths, on a cold, wintry Kansas morning. Is that really how a man calls his wife? Nichols=B4 wife, Marife, was in th= e=20 Philippines then and it is not impossible that he was trying to reach her.= =20 But those calls also raise the possibility that Nichols was trying to reach= =20 someone else and that his marriage was actually a cover for his=20 conspiratorial dealings with individuals abroad, as McVeigh=B4s lawyer,=20 Stephen Jones, has suggested. This is a critical issue. It should have been thoroughly investigated. But= =20 it was not. This author is familiar with the official U.S. investigation=20 into Nichols=B4 activities in the Philippines. It was done almost entirely = by=20 the FBI and it is exceedingly thin. The inquiry consists of a handful of=20 interviews, transcribed months after they were conducted. This author also showed the records of Nichols=B4 calls to the Philippines = to=20 four present or former U.S. officials with backgrounds in law-enforcement= =20 or intelligence. One remarked, "It sure looks like the FBI didn=B4t want to= =20 know." The others agreed. One agency, U.S. Customs, which had a minor role in the investigation.,=20 seemed far more interested than the FBI in Nichols=B4 activities abroad. It= =20 inquired after Tom and Earl Shelton, the father and son team who ran=20 "Paradise Shelton Tours," the agency through which Nichols met and married= =20 Marife. (By the time of the bombing, the Sheltons had left the Philippines,= =20 the son allegedly expelled for pederasty). Warren Marik, a retired CIA=20 officer, remarked that the sex tour agency would have been an ideal place= =20 from which a foreign intelligence agency might recruit dissatisfied America= ns. A note written by Nichols also raises questions. Before his last trip to=20 the Philippines, Nichols feared he might die. He left several letters with= =20 his ex-wife, instructions to various people, regarding the disposition of= =20 his property, if he did not return. One note, addressed to McVeigh, included the widely publicized phrase,=20 "Your on your own. Go for it!!" That was interpreted to mean that if=20 Nichols did not come back, McVeigh should carry out the bombing himself.=20 But the letter, in its entirety, suggests there would have been no bombing,= =20 if Nichols did not return from the Philippines. The letter begins with directions to McVeigh regarding a storage locker in= =20 Council Grove, Kansas. It contained valuables from a robbery, and Nichols= =20 referred to it as "CG 37." The first nine lines of the note explain what to= =20 do with that locker and include oblique reference to the circumstances=20 under which McVeigh is receiving the note. The tenth line is the phrase,=20 "You=B4re on your own, go for it," after which Nichols signed his name. Below Nichols=B4 signature are four paragraphs, essentially afterthoughts.= =20 The second paragraph contains instructions for forwarding Nichols=B4 mail.= =20 The third provides more detail about handling the locker with the loot from= =20 the robbery. The fourth states explicitly that if McVeigh has received the= =20 letter, Nichols has died. The first paragraph says merely, "Also liquidate 40." That is terribly=20 important. "40" refers to another storage locker. It contained a ton of=20 ammonium nitrate, one of the bomb=B4s basic ingredients. "Liquidate 40" in= =20 its most obvious sense means get rid of the material. It does not mean mix= =20 it with fuel oil, put it in barrels in the back of a Ryder truck and blow= =20 up a federal building. Indeed, "Liquidate 40" is followed by instructions about picking up the=20 mail. The ammonium nitrate has essentially the same status as the mail.=20 Both are entirely secondary. Thus, Nichols=B4 note strongly suggests that i= f=20 he did not return from the Philippines, there would have been no bomb,=20 because McVeigh was told to get rid of the ammonium nitrate. And that=20 suggests McVeigh was not the mastermind of the Oklahoma City bombing.
