Because the anti-self defense lobby has absolutely convinced so many Americans that firearms are dangerous in any condition and at all times. Loaded or unloaded. The very presence of a firearm strikes terror into the hearts of otherwise intelligent Americans -- all because the firearm fear-mongers have succeeded so well. A loaded firearm lying quietly on the sink poses no danger to anyone unless they pick it up and misuse it. A whole generation of Americans has been systematically propagandized against having any interest or knowledge about firearms. Uneducated children became ignorant and fearful adults. What used to be common sense has disappeared. Grown men and women cower and shake when a gun is around. Would the flight crew have aborted the flight had a bow and arrow been found under a seat? Or a long knife? A single firearm, an inanimate object lying inertly without a person attached to it, was enough to terrify Delta into bringing down an airliner... and that story made national news on the AP Wire. The novel is large and offers four love stories, a spaceship battle, a double murder mystery, a detective from Atlantis and his talking dog. It seriously discusses life-and-death ethics, epistemology, metaphysics (the Aristotelian kind), physics, evolution, the authoritarian personality, and politics of unanimous consent. In many ways, it's my most ambitious literary undertaking so far. I've never had any illusions about how much one book can affect a culture. I don't believe _Uncle Tom's Cabin_ started the War between the States. I think of each of my books as a photon torpedo aimed -- it's to be hoped -- straight at the enemy fleet's flagship. Unfortunately, Amazon.com is carrying a snide, nasty Kirkus Review of _Forge of the Elders_ clearly written by someone who didn't read the book (it contains several factual errors), that will keep people from reading it who would otherwise enjoy it. When I asked who was paying for the poll, the caller said she "didn't know so [she] couldn't bias the results." The first time they called they started by asking a question about which issue I felt was most important in Washington with a list of possible answers ranging from "providing strong leadership," to "strengthen military," to "strengthen education." The second question was, "If the election were held today would you voter for Cook, Wright, or Smith." When I said I was undecided and wouldn't provide that info anyway, she was out of questions. Thirty minutes later they called again. They confirmed I was a delegate in 2nd CD. Then asked my first impression of "some politically active people"--there were three, Smith, Cook, Wright. I gave very vague answers on all. She then asked me to rank the importance of several issues in deciding how I will vote. These were basically the same questions as before. Of course, I ranked everything clearly outside the bounds of Congress as zero and things in the bounds of Congress higher. Next was the "if the election were held today." This time I just said undecided. This brought a "What hesitation do you have for voting for Cook?" to which I responded, "He's been weak on 2nd amd rights." They then asked some "demographic" questions including age, religion, activity level in that religion, and whether I considered myself politically conservative, moderate, or liberal. I answered that one with, "moderate." Which of course I am. :) Anyone more conservative than me is a fanatic and anyone less conservative than me is obviously a pinko-commie liberal. :) :) So that makes me a moderate. Hostettler is working to end the Clinton administration and HUD's lawless plan to enact gun control by trial lawyer. Smith & Wesson has already caved in to the threats of lawsuits intended to bankrupt gun manufacturers. The agreement S&W signed requires the registration of all guns, government licenses for all firearms purchasers, background checks as long as the FBI chooses to make them, firearms rationing, mandatory trigger locks, and more. It also mandates a government "Oversight" Commission (all but one of whose members will be anti-gun government officials and bureaucrats) to enforce the terms of the agreement. This is where Rep. Hostettler comes in. He is circulating letters to Reps. Kolbe and Walsh (appropriations subcommittee chairs for HUD and Treasury-BATF) to obtain support for budget amendments defunding the Oversight Commission. Without funds, the commission won't be able to do very much enforcement. So far, Rep. Merrill Cook and Rep. Jim Hansen have signed the Hostettler letters. Thanks to Rep. Cook and Hansen - and to all of you who took the time to contact them! Your hard work is paying off! But Rep. Chris Cannon is mysteriously missing in action. UTGOA called his office to find out what's going on - but no one has responded. This is inexcusable. Rep. Cannon claims to be a conservative, pro-gun Republican. Yet he's apparently not interested in defending the rights of Utah gun owners or Utah firearms manufacturers. This is particularly shocking coming less than a month before the Republican Convention where he will ask for his party's endorsement for another term in Congress. Perhaps he's been in Washington long enough that he needs to be reminded who elected him - and what we expect him to do! Rep. Cannon needs to hear from all Utahns - and especially his constituents! The defendant, Thomas Gaule, stood convicted of voluntary manslaughter with a deadly weapon, a charge which could have netted him years in the state pen. Last year, a Clark County jury had convicted Gaule, 43, of chasing Ricky Tripp down Lakehurst Road in Las Vegas on Oct. 25 of 1998, and killing him with a shotgun. Officials at the Nevada state Division of Parole and Probation recommended a sentence of at least four years in prison. Generally speaking, a fellow in the position Mr. Gaule found himself in last Tuesday would be well advised to have brought along a toothbrush. But that's when the unusual things began to happen. Rising to oppose the recommendation of the Division of Parole and Probation was ... Chief Deputy District Attorney Bill Koot. "This case has been troublesome to me personally for as long as I've been assigned to this case," said Koot, who rarely stands to oppose the sentencing recommendations of the Parole Division. But in this case, Mr. Koot said he doubted prison time would serve any purpose. More, he said he believed jailing Gaule would send "the wrong message," that members of the public do not want to see a citizen go to prison in a case like Gaule's. Judge Gibbons promptly agreed: "If there's ever a case with extenuating circumstances, this is the one." The judge then sentenced Thomas Gaule to a period of probation not to exceed three years -- no jail time. For killing two men with a shotgun. If prosecutor Koot was so troubled, of course, one might ask why he pursued the case at all. But let's admit it did take some political courage to do what he and Judge Mark Gibbons did last week. Why did they do it? What happened to Thomas Gaule on the afternoon of Oct. 25, 1998 is that he came home to find two burglars in his house. He testified the two men jumped him and beat him severely, shocking him repeatedly with high-powered stun guns. He can still show the scars on his neck. Somehow, Gaule managed to make it into another room to retrieve a shotgun. He testified at his trial the men came at him even after he had retrieved the firearm, wrestling with him for control of the weapon. So Thomas Gaule shot them. Jason Allen Lamb was hit inside the house and died in the driveway. Ricky Tripp died 500 feet down the street, after Gaule chased him out of the house and fired again. In the death of Jason Allen Lamb, no charges were ever filed. Kill a burglar and assailant in Nevada, in self-defense, at the scene of the crime, and it's "case closed." Rightly so. In the death of Ricky Tripp, the question was whether a victim and homeowner -- Gaule -- has a right to chase down a home invader and assailant after that assailant turns to flee. Was Gaule still in fear for his life at the time he fired his final shot? The trial jury thought not. But was Gaule stunned and confused enough by his experience that his actions are excusable -- can society reasonably expect a man shocked with high-voltage taser blasts to the neck, on top of the fight-for-your-life adrenalin dump which could overrule normal deliberation for any average person caught in such a crisis, to pause at his doorway and muse on the intricacies of the laws of self-defense? Doubtless adding weight to Judge Gibbons' burden last Tuesday was the fact that Thomas Gaule is a quirky character, possessed of unusual opinions. "I think he's extremely paranoid ... obsessed with what he perceives to be an injustice," says prosecutor Koot. But Thomas Gaule has never been known to commit another violent act, before or since. Nor should defendants be sent to prison for their "oddball views," as correctly observed by Gaule's attorney, Peter S. Christiansen. In the end, Judge Gibbons authorized probation officials to require counseling for Mr. Gaule, and treatment for depression. And then he sent Thomas Gaule home. In the end -- while a felony trial and record are no picnic, and the jury clearly issued no license for others to engage in armed pursuits -- the county and the court decided the most important thing here was to protect the citizen's sacred right of self-defense. The county and the court ruled an otherwise peaceful Nevadan shouldn't go to prison for defending himself in his own home, even with deadly force, even if -- in the heat of a fight for his life -- he chases one of his tormentors out the door and down the street. It was a tough call. It's an oddity of modern American jurisprudence that civilians are held to a much higher standard than trained cops when it comes to shootings that aren't clear-cut self-defense. The instructions ask the House-Senate conferees to produce a bill that contains the bulk of the gun restrictions that were in the original juvenile bill, as well as some Project Exile-type provisions. It contains several errors, especially in the statement that "The only time the U.S. Supreme Court has ruled on the matter was the 1939 case United States v. Miller. The court found that Miller's sawed-off shotgun had nothing to do with militia participation. He had no right to the weapon." The Supreme Court said no such thing. What it did say is that Miller had not presented evidence or argument that the weapon was suitable for militia use, something that would have been difficult as Miller had died before the case came before the Supreme Court and was not represented during final argument. In fact such weapons had been used in warfare and were suitable for militia use, as is almost any functional weapon under some circumstances. And the Supreme Court did not rule on whether Miller had a right to the weapon, or that the government had the power to prohibit possession of it. It only ruled that if not shown to be suitable for militia use it could be taxed. In later cases, such as Rock Island Armory v. U.S. the court has ruled that since the government refuses to accept payment of the tax, it has no power to penalize a person for failing to do so, or for possession of the item, or to use nonpayment of such tax as an excuse to seize the weapon. The "constitutional scholars" cited in the article have gun control agendas and their views are not supported by intellectually honest and competent scholarship. Unregulated bathtubs cause over 200,000 injuries every year. There are over 100 drownings and 70 people "cooked" to death in scalding bathwater each and every year. Add the suicides, falls, and deliberate murders that take place in tubs, and the death toll mounts. Sadly, children comprise 75% of the fatalities. Many European nations have long recognized the risk inherent in bathtubs and have reduced their use. Yet in the United States, the bathing culture is rampant, and leads to death and suffering on a gigantic scale. There are those who claim that bath tub use is justified under certain circumstances. Some claim bathtubs are necessary for cleanliness. Is personal vanity more important to you than a child's safety? Recreation is often espoused as a legitimate use of the bathtub but can be disregarded out of hand. No brief thrill is worth the cost of maintaining one of these deadly instruments of destruction in your home. Research shows that the chances of drowning or being boiled in your bathtub are far greater than the chances of inducing a supermodel of the opposite sex to share one with you. Steps should be taken at once to register all tubs. Our government at present doesn't even know for sure how many of these killer devices exist! Simply incorporating a few questions into the next census would help authorities to determine the size of the regulatory agency needed to enforce license requirements. Many bathtubs hold up to 18 inches of water. The variety known as the "spa", "hot tub" or "Jacuzzi" may hold even more, and these types have all too often been implicated in cases of date rape. Some of these assault tubs can have as much as 24 inches of water and various automatic jets, whirlpools, and heaters which make them attractive to the criminal bather. The legislature should take steps to limit all new bathtubs to holding 10 centimeters of water. This should reduce the chances of mass drowning significantly. Of course, children make up the overwhelming number of bathtub victims. Even if you don't own a bathtub, your child's friends may have parents who are irresponsible bathers. The common sense solution is for people to use Tap Locks. Tap Locks can be easily mandated by government, enforced by a new agency set up specifically with tub safety in mind, and subject to in-home inspections at households with registered bathtubs. Regardless of any "right" claimed by the pro-bathing crowd, (a right which isn't even mentioned in the Constitution) precedents have already been established for bathroom fixture regulation. The Supreme Court has so far refused to hear the cases involving "environmentally friendly" (1.3 gal. flush capacity) commodes, thereby pointing out the foolishness of those who say that the government requirement of a toilet that doesn't work is some kind of tyranny. We should continue to educate these malcontents and inform their children of the stubborn and selfish ways of their parents. How can you get involved in insuring your children's safety? The most important thing you can do is to eliminate your bathtub immediately. Your tub is not "necessary" to your family's well being, and in fact is more likely to kill or injure a member of your family or a friend than it is to drown a burglar. The benefits of eliminating your tub will be immediate and noticeable. There will be a certain air about you that says, " I did away with my bathtub and I'm safer for it." Lobby your legislators to immediately invoke new laws to insure your safety from tubs. Give them money if you have to. Write nasty letters, stage protests, and organize anti-bathing individuals to stand around in legislative organizations dedicated to your safety from this menace. It's already against the law for a convicted felon to purchase or possess a firearm; it's already against the law for a minor to purchase or possess a handgun; there is already a law requiring background checks on gun buyers; gun dealers are already heavily regulated; many states have laws to punish adults for failure to store guns safely. Why then do people insist that more laws are needed? Why do they clamor for safer guns when firearm accidents account for only 1,400 of the 90,000 accidental deaths annually in the United States? Well, I personally think that their motive has nothing to do with fighting crime or with safety. After all, firearms are dead last as a cause of accidental fatalities among both children and adults. Doctors, we now know, kill three times as many Americans annually from mistakes than firearms kill, counting homicides, suicides and accidents. I think that the answer is both old and simple. Gun-control laws have always been elitist and racist. Elitists have always wanted to disarm the common folks while, of course, retaining the privileges of arms for themselves. And the right to keep and bear arms has always been a populist cause. James Madison boasted to a European critic that the new country of America, unlike his country, did not fear its own people and allowed them to own arms. In fact, that Second Amendment right to keep and own arms is one of the things that makes America unique. Many countries protect speech and assembly and so forth. Almost no other protects the right of its people to keep arms. You may, of course, think that the Second Amendment is obsolete. I would ask you to reconsider that. If you noticed in the last Los Angeles riot, neither the police nor the military was on hand initially to protect people's lives and property. The people had to protect themselves, and they did it with firearms. This is always true in a major disaster -- at least initially. Any honest cop will tell you that if you are attacked by a criminal, on the street or in your home, you are on your own. It's up to you to defend yourself and your family. If you think that you are physically fit enough to disarm armed intruders, then more power to you. But every martial artist I have known says there is no substitute for a handgun when it comes to serious self-defense. If the only things needed to prevent crimes were laws and policemen, then there wouldn't be any crime statistics. But every murder, every rape victim is testimony to the fact that neither the law nor the police can protect individuals from criminal attackers. On the other hand, very respectable studies have shown that firearms are used by Americans more than a million times a year to prevent crimes, usually without having to be fired. It used to be said in America that God created people but that Samuel Colt (inventor of the revolver) made them equal. Indeed, a firearm is an equalizer. With a gun, an elderly person or a woman or a small, sickly man can stand up to a young and large thug. It was the invention of firearms that ultimately ended the practice of professional warriors being the ruling class. It seems as self-evident to me as it was to the Founding Fathers that a people disarmed by their government cannot purport to be free. The bottom line remains: Force rules. Therefore, if you allow the government to have a monopoly on force, then you can never purport to be a free person.
